The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Public
Hearing and a Regular Session on 23 September 2004, at 7:00 pm in the Boardroom of
the Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262.

1. CALL TO ORDER AND ANNOUNCE A QUORUM.
Chairman Hill called the meeting to order at 7:02 pm, announced a quorum was
present and explained the format of the meeting for the benefit of the audience.

3. PLANNING & ZONING COMMISSION TO CONDUCT A PUBLIC HEARING RELATIVE TO
THE FOLLOWING:
Chairman Hill read the caption into the record.
A. A 1.5 ACRE TRACT OF LAND REFERRED TO AS "PAD 1OH" LOCATED
APPROXIMATELY 200 FEET EAST OF THE TROPHY CLUB MUNICIPAL UTILITY
DISTRICT WASTEWATER TREATMENT PLANT AND APPROXIMATELY 2,400 FEET
WEST OF THE WESTERN MOST PORTION OF SKYLINE DRIVE LOCATED IN THE
EAGLES RIDGE SUBDIVISION AND MORE PARTICULARLY DESCRIBED AS
BEING A TRACT OR A PARCEL OF LAND SITUATED IN THE MARY MEDLIN
SURVEY, ABSTRACT NUMBER 832, TOWN OF TROPHY CLUB, DENTON COUNTY,
TEXAS, AND BEING PART OF TRACT 1 AND TRACT 8B CONVEYED TO BECK
PROPERTIES TROPHY CLUB, L.P. BY DEED RECORDED IN CLERK FILE NUMBER

Mr. LeDesma addressed the Commission. The presentation overviewed the Barnett
Shale, depicting vertical, horizontal and directional drilling cross sections and an index
map showing the current Barnett Shale gas region. Four slides were shown detailing the
production history on a monthly basis for the Brumbaugh #2 well in Tarrant County, the
Corral City # 1 well in Denton County, the McAllister # 16 well in Wise County, and the
Mount Olivet #2 well in Tarrant County.
Mr. LeDesma went on to show the proposed pad site for well 10H which is located in
close proximity to the Wastewater Treatment Plant. In addition, the applicant stated
the estimated reserve damages for this well would range in losses of 11-20 million.
There were no requests to speak from the public.
B. A REQUEST FOR WAIVER TO THE REQUIREMENTS SET FORTH IN TOWN
ORDINANCE NO. 2004-11 P&Z, SECTION "C" ENTITLED "OIL AND GAS WELL
DRILLING AND PRODUCTION 'BY SPECIFIC USE PERMIT (SUP)"', SUBSECTION
(1), PERTAINING SPECIFICALLY TO THE REQUIREMENT FOR A ONE -THOUSAND
FOOT (1,000') SETBACK FOR THE LOCATION OF A GAS WELL PRODUCTION
SITE DESCRIBED AS "PAD 1 OH".
There were no requests to speak from the public.
4. PLANNING & ZONING COMMISSION TO CLOSE PUBLIC HEARING AND/OR
CONTINUE TO A DATE CERTAIN.

RECOMMENDATION TO THE TOWN COUNCIL REGARDING:

Commissioner Reed asked if the application was in compliance with the ordinance and
if the Municipal Utility District had any comments about the site request. Ms Fleck
confirmed the application appears to be in compliance and Robert Scott, MUD
Superintendent said the District had no objection to the site location.
There was a motion to approve the request for SUP for Pad 1 OH.

Commissioner Stephens asked if approval of this would set a future precedent. Ms.
Fleck stated that each application will stand on it's own merit.
There was a motion to approve the request for waiver.
