Minutes P&Z 11/16/2006 MINUTES OF A PUBLIC HEARING & REGULAR SESSION FOR THE TOWN OF TROPHY CLUB PLANNING AND ZONING COMMISSION 16 NOVEMBER 2006 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Public Hearing and a Regular Session on 16 November 2006, at 7:00 pm in the Boardroom of the Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262. COMMISSIONERS ATTENDANCE: Chairman Hill excused Vice Chairman Stephens present Commissioner Ashby absent Commissioner Moss present Commissioner Reed excused Commissioner Sheridan present Commissioner Stamos present STAFF AND GUESTS PRESENT: Kerin C. Fleck Planning & Zoning Coordinator Lisa Escue Applicant, Realtor A.1 CALL TO ORDER AND ANNOUNCE A QUORUM. 7:0pm Vice Chairman Stephens called the meeting to order at approximately 7:05 pm, announced a quorum was present and explained the format of the meeting for the benefit of the audience. PUBLIC HEARING B.1 Public Hearing: Consider a Replat for 20 and 22 Cypress Court, also described as Lots 12 and 11 of Block B in the Villas of Hogan's Glen. (RP-06-003) Vice Chairman Hill read into the record an email from Scott Beck, regarding this agenda item. Thank you for taking the time to review this request for the re-plat of certain lots located within the Villas of Hogan’s Glen. It came to our attention earlier this year that some of the utility lines that where within the Villas of Hogan’s Glen are outside of the easements. We have worked with City Staff and Engineers, including Beth Anne Gregory and Kerin Fleck, along with members of the MUD to locate the existing sewer and utility lines within this area. The re-plats depict the adjusted easements reflecting the appropriate locations of the lines. Additionally, when the property was developed initially, lot 12 within the Villas Block B, was designed such that the entrance to the lot from the street is too narrow. Therefore, we are requesting that lots 11 and 12 be combined into one lot. Additionally, it should be noted that the two lots adjacent to these lots, lots 9 and 10 have already been combined several years ago with lot 9 being used as a private putting green and gazebo and lot 10 a single family residence. B.2 Public Hearing: Consider an amendment to the Code of Ordinances of the Town, Chapter 13, "Zoning", Article V, "Supplementary District Regulations", Section 5.03, "Accessory Structures and Uses", by revising paragraph A(1)(a), and adding a new Section "G", entitled Public Views", in order to provide screening requirements for accessory structures. (ADM-06-026) Ms. Fleck introduced the item. The proposed changes are based on the Commission’s previous discussion of the item as well as staff input. REGULAR SESSION C.1 Discuss and take appropriate action relative to a request for Replat for 20 and 22 Cypress Court, also described as Lots 12 and 11 of Block B in the Villas of Hogan's Glen. (RP-06-003) The Commission discussed the item. Commissioner Stamos stated he has no issue with the proposed plat, however he feels that a representative of the applicant should be present at the meeting and therefore he will vote against the request. A motion was made to approve the request for Replat. Motion: Sheridan Second: Moss Ayes: Stephens, Moss, Sheridan Nays: Stamos Action: 3-1 Motion carried. This item will be forwarded to the Town Council 20 November 2006. C.2 Discuss and take appropriate action relative to a request for Plat Amendment to 32 and 30 Cypress Court, also described as Lots 6 and 7 of Block B in the Villas of Hogan's Glen. (AP-06-011) The Commission discussed the item. Commissioner Stamos reiterated his previous statement about applicant representation. A motion was made to approve the request for Plat Amendment. Motion: Sheridan Second: Moss Ayes: Stephens, Sheridan and Moss Nays: Stamos Action: 3-1 Motion carried. C.3 Presentation, discussion and appropriate action relative to a request for Meritorious Exception to the requirements set forth in the Code of Ordinances, Chapter 5, Article 4, Section 4.06 pertaining specifically to Inflatable Signs. Lisa Escue addressed the Commission. She had recently purchased an inflatable REMAX® sign approximately eight feet (8’) in height and six feet (6’) in width. Ms. Escue went on to say the inflatable would be displayed at open house properties no more than ten (10) times throughout the year, for no more than four (4) hours at a time. The Commission discussed the request. Commissioner Stamos asked if the request were to be approved, would the Town be opening Pandora’s Box? Commissioner Sheridan said he was opposed to inflatable signage in Town. Vice Chairman Stephens read into the record a letter from Chairman Hill on this item. I oppose this request for temporary inflatable signage at multiple, unspecified locations. To allow one realtor such an exception would be a precedent and would open the proverbial “can of worms” throughout the Town to any and all commercial entities who wish to use this means of advertising. A. Section 4.10 of Article 4, Chapter 5 of the Code of Ordinances states a primary objective of the Ordinance is, “ensuring against the kind of signage that has led to low visual quality”. I believe that inflatable signage of the requested type would be of a low visual quality. B. The proposed inflatable signage in my opinion would be of no obvious merit to any particular site or location, nor would it make a positive contribution to the visual environment. C. I do not see that denial of the request for temporary inflatable signage and adherence to the provisions of the criteria of Section 4.10 of Article 4, Chapter 5 will constitute a practical difficulty or unnecessary hardship for the applicant. My recommendation would be to deny the request. A motion was made to table this item in order to adopt language that would be applicable to this type of request.
