Minutes P&Z 12/06/2007 MINUTES OF A REGULAR SESSION FOR THE TOWN OF TROPHY CLUB PLANNING AND ZONING COMMISSION DECEMBER 6, 2007 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Regular Session on December 6, 2007, at 7:00 pm in the Conference Room of the Public Services Building, 100 Municipal Drive, Trophy Club, Texas 76262. Chairman Hill called the meeting to order at 7:00 p.m. with all members present. B.1 REVIEW AND APPROVE MINUTES OF THE NOVEMBER 15, 2007, PLANNING & ZONING COMMISSION MEETING. Commissioner Forest motioned to approve the minutes of the November 15, 2007, Planning & Zoning Commission meeting. The motion was seconded by Commissioner Reed. Ayes: Hill, Reed, Sheridan, Sanchez, Forest Nays: None Abstain: Stephens, Ashby Action: 5-0-2, Approved Mr. Stephens and Mr. Ashby abstained as they were absent on November 15, 2007. C.1 PUBLIC HEARING TO CONSIDER AN AMENDMENT TO PLANNED DEVELOPMENT NO. 25 (PD-25), ORDINANCE NO. 2002-41 P&Z TO AMEND THE DEVELOPMENT STANDARDS “PERMITTED USES” TO ALLOW A HOTEL USE ON TRACTS 6 & 7, AND TO AMEND THE “HEIGHT” RESTRICTION FOR HOTEL USES. APPLICANT: HIGHWAY 114 PROSPECT, LTD. (PD AMD-O7-026) This item has been rescheduled to the December 20, 2007, P&Z meeting to allow proper notification of homeowners within 200-ft. of the property on which the change is requested. Planning & Zoning Commission Page 1 of 3 December 6, 2007 Minutes D.1 CONSIDERATION OF A REQUEST TO GRANT A ONE YEAR EXTENSION OF A PRELIMINARY PLAT OF THE HIGHLANDS AT TROPHY CLUB NEIGHBORHOODS 1, 2, 5, 6, AND 7. APPLICANT: LENART DEVELOPMENT COMPANY, LLC. Steve Lenart, Lenart Development Company, requested a one year extension per City Ordinances for the preliminary plats of Neighborhoods 1, 2, 5, 6, and 7 of The Highlands of Trophy Club. He stated that they have submitted plans for five of the first phases of neighborhoods 1, 2, 5 and 6 and early grading has begun in ten phases. Ms. Huggins explained that staff requested the extension of the plat because final platting of neighborhood 7 has not been initiated. The ordinance requires that final platting initiated by the developer within twelve (12) months from the date of approval of the preliminary plat. Although final platting has been initiated for the neighborhoods (1, 2, 5 and 6), staff wanted to be assured that the preliminary plat would be valid when final platting of neighborhood 7 is initiated. Mr. Ashby asked if anything has changed from the original preliminary plats. Ms. Huggins confirmed that no changes have occurred. Mr. Sheridan asked if a one year extension is enough time. Mr. Lenart responded that it is not enough time to have it fully developed. Mr. Sheridan stated that this is not in regard to development, but in regard to final platting. Ms. Huggins responded that the final plat process must be initiated prior to the expiration of the preliminary plat. Mr. Sheridan asked once the final plat is initiated how long do they have to get the final plat completed. Ms. Huggins stated that there is not a definitive timeframe but that the project must be continually progressing toward final plat approval. Mr. Sheridan asked if “project” refers to each section individually or the while development. Ms. Huggins responded that it is considered neighborhood by neighborhood. Mr. Sheridan asked if it is possible to grant another extension a year from now. Ms. Huggins stated that the ordinance isn’t clear, but there is discussion occurring with the town management regarding how to proceed in the future if another plat extension is needed. Mr. Sheridan responded that he would like to see us work with the developer since both the Town and developer have worked hard to get where to this stage. Mr. Sheridan stated that this has always been a 5-year or more build out. He would not like to see these projects rushed through to final platting to meet a deadline and then have them come back for changes and modifications during development due to being rushed. “I’d rather see the process go through at a reasonable rate and we need to see that the ordinance is changed to allow the process to go smoothly.” Vice Chairman Stephens stated that they are asking for 12 months in order to keep from having to go back to square one and pay fees again. Mr. Lenart stated that there is no doubt that they will be here a year from now for the last several phases. It is not realistic to get to those phases that quick. Staff is comfortable with asking for a one year extension in order to see how the development progresses over the next year. Commission Reed asked if the ordinance needs to be changed to allow for more than one extension. Ms. Huggins will follow up with Town Management and the Town Attorney to get clarification as to whether or not the ordinance allows another extension. Ms. Huggins also explained that the Planning & Zoning Commission is granting or denying the extension. This request does not go on to the Town Council. By ordinance, the Planning & Zoning Commission has the authority to grant the extension. There was no further discussion and Mr. Ashby made a motion to approve a one year extension of the preliminary plats of The Highlands at Trophy Club Neighborhoods 1, 2, 5, 6 and 7. Vice Chairman Stephens seconded the motion.
