ORD. 2021-11 - Fee Schedule TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 2021-11 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING SECTION A1.003 COMMUNITY DEVELOPMENT DEPARTMENT, SECTION A1.011 POLICE DEPARTMENT, AND SECTION A1.012 PARKS AND RECREATION AND SPECIAL EVENTS OF ARTICLE A1.000, GENERAL PROVISIONS, OF APPENDIX A, FEE SCHEDULE, AND CHAPTER 1, GENERAL PROVISIONS, SECTION 1.08.098 USAGE FEES AND SECTION 1.08.121 APPLICATIONOF THE TOWN OF TROPHY CLUB CODE OF ORDINANCES TO UPDATE FEES; PROVIDING FOR INCORPORATION OF PREMISES; PROVIDING FOR AMENDMENTS; PROVIDING A SAVINGS AND REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PUBLICATION CLAUSE; PROVIDING A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR EACH VIOLATION; PROVIDING AN ENGROSSMENT AND ENROLLMENT CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS,fees imposed by the Town are adopted via Ordinance and are codified in Appendix A, Fee Schedule, of the Town of Trophy Club Code of Ordinances; and WHEREAS, having reviewed the proposed cost adjustments, the Town Council finds that the proposed fee adjustments are reasonable and necessary to pay the administrative costs associated with providing services to the public; and WHEREAS, the Town Council hereby finds that amending Section A1.003 Community Development Department, A1.011 Police Department, and Section A1.012 Parks and Recreation and Special Events of Article A1.000, General Provisions, of Appendix A, Fee Schedule, of the Town of Trophy Club Code of Ordinances as further specified herein serves the best interests of the health, safety and welfare of the citizens of the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION 1. INCORPORATION OF PREMISES That the above and foregoing premises are true and correct and are incorporated herein and made a part hereof for all purposes. Page 1 of 8 ORD 2021-11 SECTION 2. AMENDMENTS 2.01 Subsection (b), (c), and (m) of Section A1.003, Community Development Department, of Article A1.000, General Provisions, of Appendix A, Fee Schedule, of the Town of Trophy Club Code of Ordinances are hereby amended as follows and all other subsections not expressly mentioned hereafter shall remain the same: APPENDIX A FEE SCHEDULE ARTICLE A1.000 GENERAL PROVISIONS Sec. A1.003 Community Development Department (b) Apartment complex license: (4) Reinspection: $100.00 (c) Building (commercial): TABLE 1 -COMMERCIAL BUILDING PERMIT FEE $1,000,000.01 and up $12,030.00 for the first $1,000,000 plus $ 6.60 for each additional $1,000.00 or fraction thereof (m) Inspections: (2) Reinspection fee: $100.00 first reinspection; $150.00 each additional reinspection. 2.02 Section A1.011, Police Department, of Article A1.000, General Provisions, of Appendix A, Fee Schedule, of the Town of Trophy Club Code of Ordinances are hereby amended as follows and all other subsections not expressly mentioned hereafter shall remain the same: APPENDIX A FEE SCHEDULE ARTICLE A1.000 GENERAL PROVISIONS Sec. A1.011 Police Department (m) Special events personnel fee is $50.00 per hour per person for a minimum of 4 hours. In addition, there is a $20.00 per hour vehicle fee for personnel. 2.03 Subsection (e) of Section A1.012, Parks and Recreation and Special Events, of Article A1.000, General Provisions, of Appendix A, Fee Schedule, of the Town of Trophy Club Code of Ordinances are hereby amended as follows and all other subsections not expressly mentioned hereafter shall remain the same: Page 2 of 8 ORD 2021-11 APPENDIX A FEE SCHEDULE ARTICLE A1.000 GENERAL PROVISIONS Sec. A1.012 Parks and Recreation and Special Events (1) Harmony park pavilion rental (4-hr): (A) Resident: $50.00. (B) Nonresident: $100.00. (2) Independence Park fees per hour (residents only): Multi-use field #2 - with lights (two-hour increments) $50.00. (3) Tournament fees: (A) TCRYBA baseball tournament gate fees (per team): $175.00. (B) TCRYBA tournament overflow game fee (per game): $125.00. (4) Tournaments outside of those sponsored by the TCRYBA will be charged according to the town's special event application and tournament agreement. (5) Tournament qualifier generally a 1-3 day tournament. (A) Tournament fee: $9,500.00 MIN includes the first 50 teams; gate fee is $125.00 per team for each team over the initial 50. Payment for tournament fees is due ten (10) working days after conclusion of each tournament. (B) Deposit of$2,000.00 is due when this agreement is executed. (C) All overflow tournaments will be based on 0-50 games @ $125.00/game, plus 51 or more games will be an $85.00/game fee. (Example -63 game overflow weekend, 50 games x $125.00 = $6,250.00 plus 13 games x $85.00 = $1,105.00 - grand total = $7,355.00). (6) National tournament is a 4 or more day tournament: (A) Tournament fee $4,000.00 per day at Independence Park (east and west) Ballfield Complex and $2,200.00 per day at Independence Park West and/or $1,700.00 per day at Independence Park East. There will be no gate fee. Payment for tournament fees is due ten (10) working days after conclusion of each tournament. A partial annual pass is sufficient to allow the issuance of a replacement pass if the salvaged portion of the pass contains either all or a portion of the registration number on the original pass. The cost of such replacement pass shall be $5.00 for residents and $10.00 for non-residents to cover costs of voiding the old pass and issuing a new pass. If an applicant is unable to return the old pass, either in whole or in part, and a new pass is requested, then such applicant shall be required to purchase a new pass at full price. 2.04 Subsection (a) of Section 1.08.098 Usage fees, of Chapter 1 General Provisions, Article 1.08 Parks and Recreation, of the Town of Trophy Club Code of Ordinances are Page 4 of 8 ORD 2021-11 hereby amended as follows and all other subsections not expressly mentioned hereafter shall remain the same: CHAPTER 1 GENERAL PROVISIONS ARTICLE 1.08 PARKS AND RECREATION SECTION 1.08.098 USAGE FEES (a) The following fees shall be collected from park users as applicable: (1) General vehicle entry $2.00 for residents and $5.00 for non-residents. (2) Boat launch in addition to General Vehicle Entry- $5.00 for residents and $10.00 for non-residents. (3) Special event permit fee: $50.00 (4) Security fee: . Special events personnel fee is $50.00 per hour per person for a minimum of 4 hours. In addition, there is a $20.00 per hour vehicle fee for personnel. (5) Annual pass(for entry fee and boat launch only): $75.00 per year for nonresidents of the town; $50.00 per year for residents and other categories of users as approved by the town council. In the event that there is a conflict between the fee charged in this division and the fee charged in the schedule of fees ordinance, the amount specified in the fee ordinance shall control the fees charged for Trophy Club Park. The annual pass is valid from January 1 to December 31 of the year in which it is issued regardless of the month in which the pass is actually purchased. The annual pass shall be displayed at all times on the vehicle for which it was issued in accordance with the applicable instructions for attachment. (6) A replacement pass may be purchased. A replacement pass may be purchased in the event that (i) an annual pass is damaged, or (ii) the vehicle for which the pass is issued is damaged or sold, or (iii) ownership of the vehicle is otherwise transferred, and (iv) the old pass is removed from the vehicle and returned either in whole or in part. A partial annual pass is sufficient to allow the issuance of a replacement pass if the salvaged portion of the pass contains either all or a portion of the registration number on the original pass. (b) Notwithstanding any provision in this division establishing a fee, in the event of a conflict between the amount of the fee specified in this division and the amount of the fee specified in the most recent schedule of fees adopted by the town council, the amount specified in the most recent schedule of fees shall control and shall be due and payable as a condition of use. Page 5 of 8 ORD 2021-11 Sec. 1.08.121 Application (a) A person wishing to conduct a special event or engage in an organized activity within the park for which a permit is required by title 36, ordinance, rule, regulation, or policy shall file an application with the town designee and pay the fees as set forth herein. (b) Permit applications for organized events or activities to be held within the park shall at a minimum provide the following information: (1) The name, address, and telephone number of the applicant. If the use or activity is to be conducted for, on behalf of, or by any person or organization other than the applicant, then the name, address and telephone number of that person or organization must be provided; (2) The date(s) and hours for which the permit is requested; (3) Type of proposed use or activity; (4) The portion of the park facility desired to be used to conduct the proposed use or activity; (5) An estimate of the anticipated attendance; and (6) Any requested site support for the permitted activity, including the need for additional sanitary and refuse facilities. (c) Permit applications for events or activities pursuant to this section shall be filed with the town designee for consideration not less than sixty (60) business days for large events and not less than thirty (30) business days for small events nor more than three hundred sixty-five (365) days before the date of the proposed use or activity, except as otherwise provided by title 36, town ordinance, rule, regulation, or policy, or if waived in writing by the town designee. The town designee shall evaluate the application and render a decision in accordance with the procedures set forth in this division within +ems thirty (30) business days of receipt of such request. (d) If the town designee determines that anticipated attendance at the activity or the conduct of the permitted activity shalt reasonably cause injury to persons or property, or be detrimental to the health, safety or welfare of the public, the town designee shall require that additional security precautions be taken to permit the use of the designated area. In such event, the town designee shall impose a security fee as specified herein to defray the cost of furnishing adequate security forces by the town at the proposed function. (Ordinance 2002-45, sec. 10, adopted 12/16/02; Ordinance 2003-06, sec. 10, adopted 4/7/03; 2006 Code, ch. 9, sec. 2.09) Page 6 of 8 ORD 2021-11 SECTION 3. SAVINGS AND REPEALER This Ordinance shall be cumulative of all other ordinances of the Town affecting setting Fee Schedules and shall not repeal any of the provisions of such ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance; whether such ordinances are codified or uncodified, and all other provisions of the Ordinances of the Town of Trophy Club, codified or uncodified, not in conflict with the provisions of this Ordinance, shall remain in full force and effect. Notwithstanding the foregoing, any complaint, action, cause of action or claim which prior to the effective date of this Ordinance has been initiated or has arisen under or pursuant to such repealed Ordinance(s) shall continue to be governed by the provisions of that Ordinance and for that purpose the Ordinance shall be deemed to remain and continue in full force and effect. SECTION 4. SEVERABILITY If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or its application to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 5. PUBLICATION The Town Secretary of the Town of Trophy Club is hereby directed to publish the Caption, Penalty Clause, and Effective Date Clause of this Ordinance as required by Section 52.013 of the Texas Local Government Code. SECTION 6. PENALTY It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision of this Ordinance shall be fined, upon conviction, not less than One Dollar ($1.00) nor more than Two Hundred Dollars ($200.00). SECTION 7. ENGROSSMENT AND ENROLLMENT The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this Ordinance in accordance with the Town Charter.
