ORDER OF THE TEMPORARY BOARD OF DIRECTORS OF THE
TROPHY CLUB TEXAS CRIME CONTROL AND PREVENTION DISTRICT
CANVASSING THE RESULTS OF THE MAY 11, 2013 ELECTION ON
PROPOSITION NO. 2
AN ORDER OF THE TEMPORARY BOARD OF DIRECTORS OF THE
PROPOSED TROPHY CLUB CRIME CONTROL AND PREVENTION
DISTRICT CANVASSING THE RESULTS OF A SPECIAL ELECTION
ON A MEASURE (PROPOSITION NO. 2), INCLUDING THE RETURNS
OF EARLY VOTING BALLOTS CAST IN CONNECTION THEREWITH,
AND DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD
ON MAY 11, 2013 PURSUANT TO CHAPTER 363 OF THE TEXAS
LOCAL GOVERNMENT CODE AND PURSUANT TO THE TEXAS
ELECTION CODE AS SUCH RETURNS RELATED TO AN ELECTION
ON A MEASURE TO CREATE THE TROPHY CLUB CRIME CONTROL
AND PREVENTION DISTRICT AND TO ADOPT A LOCAL SALES AND
USE TAX AT A RATE OF ONE-FOURTH OF ONE PERCENT WITHIN
THE TOWN OF TROPHY CLUB, TEXAS, DENTON AND TARRANT
COUNTIES, AND WHICH PROPOSITION WAS PLACED ON THE
TOWN OF TROPHY CLUB'S JOINT GENERAL AND SPECIAL
ELECTION BALLOT; REQUESTING THAT THE TOWN TAKE ALL
NECESSARY ACTIONS TO CANVASS THE RESULTS OF ITS MAY 11,
2013 GENERAL AND SPECIAL ELECTIONS, INCLUDING
ACKNOWLEDGING THIS ORDER CANVASSING PROPOSITION NO. 2
AND DECLARING THE TROPHY CLUB CRIME CONTROL AND
PREVENTION DISTRICT CREATED; PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDING FOR THE
CONFIRMATION OF VOTE TABULATIONS; PROVIDING FOR
ENACTMENT OF THE PROPOSITION; PROVIDING FOR THE
ISSUANCE OF CANVASS OF JOINT SPECIAL ELECTION;
PROVIDING A DECLARATION OF CREATION OF THE DISTRICT;
PROVIDING FOR SEVERABILITY; PROVIDING FOR ENGROSSMENT
AND ENROLLMENT; AND PROVDING AN EFFECTIVE DATE.
WHEREAS, the Temporary Directors of the proposed Trophy Club Crime Control
and Prevention District (hereinafter "Directors") convened in an open public meeting on
February 20, 2013 and pursuant to Section 363.054 of the Texas Local Government
Code adopted an Order to call a Special Election on May 11, 2013 for the purpose of
creating the Trophy Club Crime Control and Prevention District; and
WHEREAS, subsequent to the Temporary Board's issuance of its Order of
Election and pursuant to the Board's request, the Trophy Club Town Council included
Proposition No. 2 for the creation of the Trophy Club Crime Control and Prevention

District and the levy of a local sales and use tax at a rate of one-fourth of one -percent
on the Town's May 11, 2013 ballot as part of a Joint Special Election; and
WHEREAS, prior to calling the May, 2013 election, the Directors complied with all
notice and hearing requirements of Chapter 363 of the Texas Local Government Code
and developed a proposed two year Crime Control Plan and a proposed Two Year
Budget Plan to fund the strategies and initiatives of the adopted crime control plan
through the levy of a local sales and use tax at a rate of one-fourth of one percent; and
WHEREAS, Section 363.059 of the Texas Local Government Code provides that
if a majority of the votes cast at an election favor the creation of a District, the
Temporary Directors shall meet and canvas the returns of the election and
subsequently issue an order declaring the District created; and
WHEREAS, the Temporary Directors of the proposed District is the authority
empowered to canvass the results of the May 11, 2013 election pursuant to Section
363.059 of the Texas Local Government Code, and upon canvassing election results
evidencing that a majority of the votes cast at the May 11, 2013 election were in favor of
the creation of the district, the Temprorary Board is required to issue an order declaring
the proposed Trophy Club Crime Control and Prevention District created; and
WHEREAS, because the Town of Trophy Club placed Proposition No. 2 on its
May 11, 2013 ballot, the Temporary Directors hereby request that the Town include the
results of the May 11, 2013 election for Proposition No. 2 on its canvassing ordinance;
and
WHEREAS, the returns of the Special Election, including the returns of the early voting
ballots, duly and legally made, showed that each Proposition received the following votes:

The creation of the Trophy Club Crime Control and Prevention District
dedicated to Crime Reduction Programs and the adoption of a proposed local
sales and use Tax at a rate of one-fourth of one percent.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. - Incorporation of Premises. The above and foregoing premises are
true and correct and are incorporated into the body of this Order and made a part hereof
for all purposes.
Section 2. Confirmation of Vote Tabulations. The results of the Joint Special

Election, as related to the Special Election on a measure to create the Trophy Club
Crime Control and Prevention District and adopting a local sales and use tax of one-
fourth of one -percent and as canvassed and tabulated above, reflect the expressed
desires of the resident, qualified voters of the Town. In accordance with the canvass
and tabulation of the results of the Joint Special Election, the Temporary Board hereby
declares that Proposition No. 2 received the following votes:

Section 3. Enactment of Proposition. In accordance with the canvass and
tabulation of the results of the Joint Special Election on Proposition No. 2 and consistent
with the Section 363.059 of Texas Local Government Code and the Texas Election
Code, Proposition No. 2 has been duly enacted pursuant to the canvass, tabulation, and
Election Order for Proposition No. 2 as set forth herein, and the Temporary Directors
hereby enter this Order canvassing the May 11, 2013 election results.
Section 4. Issuance of Canvass of Joint Special Election. The Chair of the
Temporary Board is hereby authorized and directed to execute and deliver the Canvass
of the Joint Special Election, a copy of which is attached hereto as Exhibit "A", in
accordance with the election laws of the State of Texas, and to take all other action
necessary in connection therewith.
Section 5. Declaration of Creation of District. Having duly canvassed the results
of the May 11, 2013 election and having found that the majority of votes cast at that
election favored the creation of the Trophy Club Crime Control and Prevention District,
the Board hereby declares the Trophy Club Crime Control and Prevention District
created.
Section 6. Severability. If any section, article, paragraph, sentence, clause,
phrase or word in this Ordinance or application thereof to any person or circumstance is
held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall
not affect the validity of the remaining portions of this Ordinance, and the Town Council
hereby declares it would have passed such remaining portions of this Ordinance despite
such invalidity, which remaining portions shall remain in full force and effect.
Section 7. Engrossment and Enrollment. The Town Secretary of the Town of
Trophy Club is hereby directed to engross and enroll this Order in the official records of
the Town
Section 8. Effective Date. This Order shall take effect upon adoption as
authorized by law.
