Consider and take appropriate action regarding a request for a Final Plat for Lots 1-10, Block A, The Cypress Estates at Trophy Club, consisting of 3.581 acres out of the Richard W. Allen Survey, Abstract No. 5, generally located south of Nottingham Drive at Annandale Drive, Denton County, Trophy Club, Texas. Strategic Link: Infrastructure & Development – Foster a business-friendly environment. Background and Explanation: The owner, Trophy Club Estates Development, LP, has submitted a Final Plat for nine (9) residential lots and one (1) common/open space lot in conformance with the approved Preliminary Plat (September 27, 2021). The property was formerly used as a gas well site, known as 4H and the three well heads are buried and capped according to required regulations. The former well heads are identified in the cul-de-sac of Iris Drive. The proposed Final Plat is located in the R-12 zoning district which requires a minimum lot size of 12,000 square feet, minimum 25 foot front and rear yard setbacks, and 10 foot side yard setbacks unless the property is adjacent to a street, in which case a 20 foot side setback is required. Lots are required to be 90 feet wide (110 feet when adjacent to a side street) and 110 feet deep (100 feet for a cul-de-sac lot). Iris Drive is an overlength cul-de-sac and the Preliminary Plat process approved the variance for and overlength cul-de-sac. A homeowner’s association (HOA) is required to be established with the filing of the Final Flat that will maintain any common elements. The applicant has annexed the property into the Abbey Moore of Trophy Club HOA and the documentation was filed with Denton County records on September 13, 2022. The park fee for the nine (9) residential lots will be due prior to the Final Plat filing with the County. 3 Page 2 of 2 The applicant submitted engineering plans and the Town Engineer has approved the plans subject to the right-of-way through the Abbey Moore HOA property open space, Lot 1X, Block H, being dedicated. A right-of-way easement has been obtained from the HOA to the owner/developer and staff is working with the Town Attorney on the assignment of the ROW easement. Additionally, Lot 30, Block G of The Highlands at Trophy Club Neighborhood 8, Phase 2B will accommodate a utility/sewer easement and staff is working with the applicant and Town Attorney to secure the easement for the sewer line. The Final Plat will not be filed until these items are completed. Financial Considerations: Not applicable. Legal Review: This item has been reviewed by the Town Attorney. Staff Recommendation: Staff recommends approval of the Final Plat subject to the following: 1. Park fees in lieu of land dedication shall be paid prior to filing of the plat; 2. The applicant was present and available to answer questions. Rowe – curious regarding past events, if the Town has received any push back from people not wanting the signs. Director Cox – stated staff is not aware of any push back for any signs. Director Cox also stated we would review any permits and ask for the sign to be removed if there was a concern. Director Cox stated this is not a Town event, but it is a non-profit organization event. Chairperson Biggs asked if there were any other discussions or questions. There were none. Commissioner Stevens made a motion, seconded by Commissioner Rowe. Chairperson Biggs called for a vote. The motion passed unanimously 4-0. 5. Receive updates on previous cases heard by the commission and active development in Town. 10 Cox provided information regarding Hutchins, they are moving fast and opening soon. Cooks was CO last week and they will have doctors and patients soon. Developer agreement 7H-8H will be going to council, along with Rosati’s SUP and 4H presentation will be coming next meeting. Chairperson Biggs inquired about the Trophy Townhomes. Director Cox stated there was no new status. Chairperson Biggs inquired about the 241 Oak Hill property. Director Cox stated the homeowners have decided to appeal and are waiting on engineering plans for demolition. Director Cox brought the discussion to change the time for future P&Z meetings.
