Background and Explanation: The subject property is located at the northwest corner of SH 114 and Trophy Club Drive and it is the existing First Financial Bank site. The Bank recently expanded and updated the main entry/east elevation. The site had one (1) monument sign and one (1) wall sign; on the south elevation. Additionally, the wall sign specifications allow up to 40 sq. ft. or the product of 2 times the lineal width of the wall, whichever greater. Wall signs shall not exceed 75% of the width or the height of the available wall area or store frontage for a tenant’s space. The existing south elevation sign was on a much larger wall and the proposed sign will be attached to the expanded area and is illustrated in the elevation image below. In this situation, the visibility from SH 114 and along will be improved for the bank and the newly remodeled entry is a good candidate for signage. Financial Considerations: Not applicable. Background and Explanation: The subject property is currently zoned R-15 Single-Family District and the Preliminary Plat is contingent upon rezoning to R-12 Single-Family District. The application was withdrawn. The proposed preliminary plat illustrates setbacks for the R-15 Single-Family District which are greater than the R-12 requirements. The subdivider will also be required to dedicate fee-in-lieu of parkland at the time of Final Plat filing. Subdivision Ordinance Variances There are two (2) subdivision ordinance waivers/variances requested with this application. 1. No connection being provided to adjacent property. Subdivision Ordinance: Section 10.02.134 Streets. (7) Projection of streets. Where adjoining areas are not subdivided, the arrangement of streets in the subdivision shall make provisions necessary for the proper projection of streets into such unsubdivided area. 2. No sidewalk being provided along east side of Triple Crown Drive. Subdivision Ordinance: Section 10.02.131 Generally. 24 Page 3 of 4 (a) Conformity to the design standards. No plat or construction plans shall be approved by the planning and zoning commission or town council, and no completed improvements shall be accepted by the town council unless they conform to the subdivision design requirements and town design standards as contained in the town’s “Subdivision Regulations and Design Standards for Paving, Drainage and Utility Improvements,” which are incorporated herein by reference for all purposes. The applicant has provided the required statement outlining the grounds for the application and all of the facts relied upon to support the request. The applicant’s letter is included as an attachment to the staff report. In response to the first waiver/variance request, the applicant states the property to the east is a single- family estate and there are no redevelopment plans in the near future. This property is similar to The Highlands at Trophy Club Neighborhood to the west and Churchill Downs to the east. (Churchill Downs is a gated community and connections to adjacent properties were not planned/desired.) Additionally, the applicant stated the proposed layout is intended to be a 6-lot enclave and have little through traffic. In response to the second waiver/variance request, the applicant’s position is there are no lots fronting on Triple Crown Drive at this time and a sidewalk is not needed. Additionally, if a developer for the tract to the east fronts or sides lots to Triple Crown Drive, the homebuilder would be required to install the sidewalks as the homes are built. Staff consideration of first waiver/variance request to connect to adjacent property: Staff has had discussions with potential developers for the tract to the east but plat submissions have not materialized. Currently there are no development plans for that property. Developments providing access to adjacent properties is typically provided as a stub-out street connection. The proposed plat places the right-of-way for Triple Crown Drive along the eastern property boundary. Therefore, this provision allows for a connection to the property to the east. In hindsight, Staff’s request of the waiver/variance is not needed. Staff supports this waiver/variance as there is 300 feet of area that can be accessed by the property to the east. Staff consideration of second waiver/variance request for no sidewalk along the east side of Triple Crown Drive: The rationale that homes are not fronting on the east side of Triple Crown Drive, at this time, is not necessarily a valid reason to not provide the sidewalk. Sidewalks provide a means for pedestrians to walk outside of the street. Should this waiver/variance be granted a sidewalk may never be constructed. It is uncommon, and many municipalities prohibit lots (defined as double frontage or through lots) backing to residential streets. Trophy Club’s zoning ordinance provides the following: Section 14.02.151 (f) Area regulations. (6) “No rear yard shall face any street…”. A sidewalk is provided for the portion extending north of Lot 6 for a sidewalk connection to ADA standards aligning with the cul-de-sac western connection. As proposed, the eastern street parkway will be 10 feet (back of curb to property line) of area maintained by the Town. Since this area is located in the right-of-way, the Town cannot require the developer to install landscaping and irrigation or require an HOA to maintain the parkway. Staff recommends the sidewalk be constructed by the developer, at the time of roadway construction, along the entire length of Triple Crown Drive. 25 Page 4 of 4 Financial Considerations: Not applicable. Legal Review: This item is under review by the Town Attorney. Staff Recommendation: Staff recommends approval with the following conditions: The Preliminary Plat is recommended for Town Council approval subject to the property being rezoned to R-12 Single-Family Residential and the Town Council approving the Subdivision Ordinance waiver/variance for the street connection to the east. Staff does not recommend the sidewalk variance along the eastern side of Triple Crown Drive. Subdivision Ordinance: Section 10.02.134 Streets. Waiver request from the requirement to make provisions necessary for the projection of a street into the non- subdivided property to the east. That property is currently a single-family estate, and the current property owners don’t have any plans to redevelop the property in the near future. This would be like The Highlands at Trophy Club Neighborhood to the west and Churchill Downs to the east as neither of those properties provided the projection of a street to their adjacent non-subdivided properties. Also, the developer of this Trophy Park Estates prefers that this development be a 6-lot enclave and not have through traffic from the adjacent properties just like The Highlands at Trophy Club Neighborhood and Churchill Downs. 2. Subdivision Ordinance: Section 10.02.131 Generally. Waiver request from the requirement to provide for a sidewalk along the east side of Triple Crown Drive. The east side of Triple Crown Drive is adjacent to the non-subdivided property and therefore has no lots fronting on it, so we don’t see the need for an additional sidewalk on this side. Also, if the non-subdivided property wherever to develop into single-family lots those lots would more than likely backup to Tripe Crown Drive. If for some reason those future lots were to front onto Triple Crown Drive that developer and those home builders would have the ability and right to construct a sidewalk within the Triple Crown Drive right-of-way.
