Minutes TC 03/10/1988MINUTES OF REGULAR MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS ) > COUNTY OF DENTQN ) The Town Council of the Town of Trophy Club met in Regular Session on Monday March 10, 1986. The meeting was held at the Municipal Utility District Building, 100 Water Plant Road, Trophy Club, Texas. The meeting was held within the boundaries of the Town and was open to the Public. . INVOCATION Mayor Pro Tem Vance led the Invocation. PLEDGE OF ALLEGIANCE Scout member Jacob Tharpe led the Pledge of Allegiance. Jacob is 12 years old and a member of Scout Troop 328. CONSIDERATION OF MINUTES Mayor Pro Tem Vance made a motion to aporove the minutes with corrections, Council Member Martignago seconded; motion carried unanimously. PRESENTATIONS BY CITIZENS Mr. Bill Richardson, Manager of the Sales Office in Trophy Club, reported to the Council that a resident had left a dog at their office who was sick and running loose. Mr. Richardson asked if the City could do anything concerning the loose dogs in the area. page 2 Council Member Dayton stated that she had read in a local paper about a Roanoke couple who were in the process of setting up a place to take in stray dogs~ Council Member Dayton will follow up on this to see if the City might use their services. Mrs. Jan Clinkenbeard stated that several months ago, Council Member Doran was going to follow up on ordinance violations concerning the house on #56 Meadowbrook. Mayor Carter stated that he would check with Council Member Doran and follow up with a letter to the residents at that address. PRESENTATIONS BY COUNCIL -Council Member Dayton stated that she was concerned over the concrete that is being dumped throughout the subdivision from all of the construction in Trophy Club and the amount of debris on some of the City streets. Council Member Dayton suggested alerting the police force to watch for illegal dumping of materials throughout the city. Mayor Carter asked John Hill to provide the Council with a litter ordinance. Mayor Pro Tem Vance suggested prohibiting the dumping of chemicals as a part of the ordinance. The ordinance will be on the next agenda for first reading. -Council Member Martignago reported to the Council that the City had received notice that the general liability insurance would not be renewed in July. He stated that he was working on the situation and would report back to the Council. -Mayor Pro Tem Vance stated that residents have pointed out to him there is no stop sign at the corner of Pebble Beach and Phoenix Drive. He stated that this is a hazardous corner. Marshal Nolte said this particular stop sign is provided for in the Ordinance but the signs are still on order. Marshal Nolte will follow-up on getting the sign in place as soon as possible. -Mayor Pro Tem Vance asked if anyone knew the status of the new runway to be built at DFW airoort. Mayor Carter stated that Mayor's from surrounding towns have formed a committee to study the situation. Council Member Dayton suggested forminq a committee of residents to look into the effects the runway might have on Trophy Club. Mayor Carter suggested addressing the formation of a committee in Executive Session. -Mayor Carter commented on how well the Volunteer Fire Department handled the recent fire at Independent American's building located at 300 Trophy Club Drive. He exoressed his appreciation for the hard work and time the volunteer's give the community. oaoe 3 Mayor Carter also thanked Roanoke and Southlake for the support they gave Trophy Club's fire department. He pointed out the extensive trainino and dedication that is involved in the volunteer fire and ambulance department DRAWING FOR BALLOT POSITIONS: APRIL 5TH ELECTION Mayor Carter asked the candidates to come forward and draw name for a position on the ballot. The names were drawn in the following order: 1. Terry Vance 2. Larry Best 3. Ted Neidenberger 4. Dick Venetoff 5. Tracy Kunkel Mayor Carter reminded the audience of the following elections: Northwest Independent School Bond Election: March 22 Northwest Independent School Board Election: April 5 M.U.D. Elections: April 5 City Council Elections: April 5 -Mayor Carter stated that several residents had complained about solicitors in the area lately. Mayor Carter asked John Hill to draft an ordinance prohibiting soliciting within the city limits. STAFF REPORTS -Marshal Nolte thanked the fire department for the fine work durinp the recent fire. He pointed out the many hours these People donate to the community. Marshal Nolte reported that he had met with the C.I.A. recently and oresented a request for stop signs. The C.I.A. reviewed the list and unanimously approved the expenditure. Mayor Carter stated that the Council had almost 100% participation at the C.I.A. meeting Marshal Nolte referred to. He stated that he had been presented a note from the C.I.A. before the meeting asking the Council if they could pay for the stop signs. The general consensus of the Council was the C.I~A. had approved the expenditure at the meeting. Mayor Carter will meet with David Weaver, President of the C.I.A. Trustees, concerning the matter. Marshal Nolte presented the Council with the monthly report from Denton County Sheriff's Department. The report was reviewed by the Council. oaoe 4 -Donna Welsh~ City Secretary, presented the financial reoort for the month. The disbursements for the month of February were in the amount of $4,840.54. The City invested in two C.D.'s in the amount of $15,000.00 each. -The City Treasurer was not in attendance. Mayor Carter stated that he would like to see the city treasurer start work on the budget for the next fiscal year and check into revenue sources for the city. PRESENTATION: JUDGE CUNWINGHAM Judge Cunningham reported that his office is issuing approximately 1,200 citations a month. Approximately 250 of these are on trucks. He reported there have been no fatalities in the area since October 1985, and the trucks are obeying the school zone in Roanoke. Judge Cunningham stated that a Trophy Club resident had approached him concerning a traffic light at the entrance. He stated that should the Council decide to have a light out up at the entrance, he could be of help. COMMITTEE REPORTS Planning & Zoning Commission- Chairman Alexander reoorted on the following items: -The Commission is going to delay any work on the Special Residential Ordinance until a someone applies for zoning in that area. -On March 17th, the Commission will address the final site plan for First Baptist Church as well as a tree preservation and landscape ordinance, streets & drainaqe ordinance and the results of the citizen survey. -86 residents volunteered for the goals and objectives committee out of the 417 survey replies. -Chairman Alexander stated that most cities have a Planning staff. He requested a full-time secretary for the P & Z. Mayor Carter asked the commission to canvass the volunteers first. -Chairman Alexander suggested asking the developer for plans concerning areas that are not currently zoned in the City. Mayor Carter stated that it is time for the Commission to reconnmend to the Council to adopt the C. !.A. deed restrictions and covenants. He also asked Chairman Alexander to have Freese & Nichols submit a pr000sal for determining page 5 the condition of the streets in Trophy Club Council Member Dayton asked Chairman Alexander when the Commission would have a sign ordinance to submit to the Council. Chairman Alexander stated this was on their list of oriorities and would be addressed as soon as possible. PARKS AND RECREATION COMMITTEE Dr. Vance Booker, Chairman of the Parks & Recreation Committee, stated the Committee had met with Carter & Burgess Engineering firm to review the park plan~ He stated that some changes were made to the plan. Dr. Booker told the Council that the committee would like to work on the Master Plan concerning parks in Trophy Club. Dr. Booker met with Mike Ayers of the Corps of Engineers concerning the corp property north of Trophy Club. Mr. Flyers indicated that the land could be used by Trophy Club as a park area. Dr. Booker will follow-up on this. PARK LAND DEDICATION Council Member Neidenberger reported to the Council that he, Council Member Martignago and John Sheller met with Ed Snider of Independent American concerning the 15 acres for the park. He stated that thev aoreed this would be the soecific tract for the park Ianc Council Member Neidenberger and Martignago stated that the developer was still concerned with the special residential ordinance that has yet to be passed as well as a number from the city indicating the ultimate build out for the city. The developer also stated that there would have to be some money to release the land. The committee stressed the urgency of having the land dedicated to the City in order to meet the deadline requirements in the park agreement. Mayor Carter asked the Committee to meet with the developer and find out the dolIar, figure for releasing the land. Mayor Carter also stated that the developer would receive publicity for the dedication. SAVE OUR BARN COMMITTEE Marshal EngeIbeck, Chairman of the committee, reoorted to the Council that the research on the barn was 70% complete. The committee is obtaining an estimate for the repairs on the barn. CIA/CITY MERGER UPDATE This will be addressed in Executive Session. page 6 POWER P8LE COMMITTEE Mr. Peter Reuss, Chairman of the committee, reoorted to the Council that the City was turned down on their appeal to the Public Utility Commission. He stated that Mr. Boyle, the city attorney, was preparing a list of alternatives and cost for pursuing the matter. PRESENTATION: INTERNATIONAL BUSINESS MACHINES Mr. Peter Walker, Professor of Architecture at Harvard University, presented a slide presentation on the I.B.M. development. Mr. Walker stated that ground breaking for the first phase of the development is planned for spring of 1986~ with completion in 1988. Approximately 2,000 I.B.M. employees will occupy 1 million of the initial 1.5 million souare feet of office space to be built south of State Highway 114 in the Town of Westlake. Representatives of I.B.M. stated they planned to take advantage of the natural beauty of the site by designing a low-rise camous style buildings compatible with the southwestern region, utilizing architectural features such as arcaded walkways and interior courtyards. Mayor Carter thanked the I.B.M. representatives for the presentation. CONSIDERATION OF ORDINANCES/RESCLUTIQNS: FIRST READING AN ORDINANCE QF THE TOWN OF TROPHY CLUB, TEXAS PROHIBITING THE PARKING OF MOTOR VEHICLES ON PUBLIC HIGHWAYS, STREETS AND OTHER RIGHTS-OF-WAY BETWEEN THE HOURS OF 10 O'CLOCK P.M. AND 7 Q'CLQCK A.M. EACH DAY: PROVIDING DEFINITIONS; PROVIDING A SEVERABILITY CLAUSE; PRC VIDIWG A PENAL -TY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; DECLARING AN EFFECTIVE DATE. Council Member Meidenberger made a motion to change the time suecified in the ordinance to read from 3 o'clock a.m. to 5 o'clock a.m.. Council Member Martionaoo seconded. motion carrzeo unanimousiy. AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, DESIGNATING A STOP SIGN AT 'TROPHY CLUB DRIVE AND INDIAN CREEK DRIVE WITHIN THE TOWN; PROVIDING FOR THE POSTING OF STOP SIGNS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES EXCEPT TO THE EXTENT QF C8NFLICT HEREWITN; PROVIDING A PENALTY OF NOT LESS THAN ONE PAGE 7 DOLLAR NOR MORE THAN TWO HUNDRED DOLLARS FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN EMERGENCY AND DECLAR7NG AN EFFECTIVE DATE. EXECUTIVE SESSION The Council recessed into Executive Session. OPEN SESSION Council Member Dayton made a motion to form a committee to oversee the airport runway approaches, concerning Trophy Club, and protect Trophy Club's interest and environment. Council Member Martignago seconded; motion carried unanimously. Mayor Pro Tem Vance made a motion to authorize Mayor Carter to discuss a contract with Donna Welsh as City Clerk at an annual compensation rate of $26,000. Also, Mayor Carter will work out agreements with the appropriate entities and have the attorney draft the contract. Council Member Martignago seconded the motion, motion carried unanimously. ADJOURN Council Member Neidenberger made a motion to adjourn, Council Member Martignago seconded, motion carried unanimously. rA
