The Town Council of the Town of Trophy Club, Texas met in
Regular Session on Tuesday, March 21, 1989 at 7:00 p.m. The
meeting T, held at the Municipal Utility District Building,
100 Municipal Drive. The meeting was open to the Public and
held within the boundaries of the Town.

CALL TO ORDER
Mayor Carter called the meeting to order at 7:O0 p.m.
Mayor Pro Tem Vance gave the Invocation.

CONSIDERATION OF MINUTES
Council Member Doran made a motion to approve the minutes of
the February 27th meeting as written, Council Member Hallgren
seconded, motion carried unanimously.

PRESENTATIONS BY COUNCIL
-Council Member Hallgren asked Mr. Hill if the Comprehensive
Zoning Ordinance in relation to setbacks in various areas of
Trophy Club were going to be reviewed. Council Member
Hallgren gave an example that homes on the "non-golfcourse"
side of Meadowbrook have a 25 foot rear yard setback. Some of
these homes only have a 27 foot back yard.
Mr. Hill stated he had talked with Chairman Mike Hamper about
some other problems with the setbacks in the ordinance that
should be reviewed. Chairman Hamper has informed the
Commissioners about the need to review this section of the
ordinance.
-Mayor Pro Tem Vance reported construction had begun on the
park. It was brought to the Committee's attention that
construction would have an impact on the Soccer program. In
order to accomodate the soccer program, the contractor could
delay work on part of that section of the park. He would
incur a cost of approximately $900.00 in having to bring the
heavy equipment back at the end of the soccer season, and
asked for a seven day extension to the contract completion
date due to the delay. Mayor Pro Tem Vance presented the
Council with a check from the Soccer Association in that
amount to offset the cost of the delay.
Mayor Pro Tem Vance made a motion to authorize accepting the
payment of $900.00 from the Soccer Association and modify the
park contract to add an additional one week in order to
accommodate the soccer program. This motion is also
contingent on the State's approval of these changes. Council.
Member Martignago seconded, motion carried unanimously.
-Mayor Pro Tem Vance reported to the Council that if the
M.U.D. District installed the sewer system for the Park it
would cost $4,800.00. This would be a $1,400.00 savings on
the park contract.
Mayor Pro Tem Vance made a motion to modify the park
contract to allow the M.U.D. to install the sewer at a cost
not to exceed $4,800.00 which would be a savings of $1,400.00
to the Town. This would be contingent on the State's
approval. Council Member Foley seconded, motion carried
unanimously.
-Council Member Doran reported the street design standards
were being developed by the Public Works committee. The
asphalt patching and utility cuts have also been completed.
Council Member Doran also reported that Diane Prator was
moving to Florida and the Public Works Committee would need
to advertise for another member.

-Mayor Carter stated that T.U. Electric had given the Town
and C.I.A. a refund for a billing error on street lights. The
Town received $5,878.10 and the C.I.A. received $1,440.28.

PRESENTATION: Ms.
Kim Corbin, Manager
of
the Quorum and
Indian Creek
Townhomes,
requested
a
variance
to
Ordinance
No. 0 87-24
concerning
boats and
trailers.
Ms.
Corbin
pointed
out that
currently, there
is
no
provision
in the
ordinance
for variances
and some
of
her
renters
would like to
continue
storing
their boats at
the
Quorum.
Ms.
Corbin
pointed
out that
the boats would
not
be
visible
from the
street.
Council Member Foley made a motion to consider amending
Ordinance 87-24 to allow boats in multi -family areas as long
as they are not seen from public streets. Mayor Pro Tem Vance
seconded for discussion purposes.
Mayor Pro Tem Vance made a motion to amend the original
motion to state boats should not be visible from public
streets. Council Member Hallgren seconded the motion for
discussion.
Vote on amendment: For the amendment were Council Members
Foley and Vance. Against the amendment were Council Members
Doran, Hallgren and Martignago. Amendment dies.
Vote on original motion: For the motion was Council Member
Foley. Against the motion were Council Members Doran,
Martignago, Hallgren and Vance.
Council Member Hallqren made a motion to revisit the
ordinance to consider an amendment adding a clause for-
residents
orresidents to apply for a variance. Council Member Foley
seconded, motion carried with Council Member Doran opposing.
TOWN COUNCIL TO DISCUSS THE COMPREHENSIVE ZONING ORDINANCE AS
IT RELATES TO ACCESSORY BUILDINGS AND STRUCTURES WITHIN THE
TOWN.
Attorney John Hill reviewed a letter with the Council he had
written addressing portions of the ordinance that relate to
accessory buildings.

the Comprehensive
Zoning Ordinance
back to the Planning
and
Zoning Commission
in light of
the Attorney's letter.
Council
Member Martignago
seconded,
motion carried unanimously.
The
Commission will
review the
letter and ordinance and
make a
recommendation to
the Council.
TOWN COUNCIL TO DISCUSS AND CONSIDER AWARDING THE CONTRACT
FOR INSPECTION OF THE PARK CONSTRUCTION TO THE NELSON
CORPORATION.
Mayor Pro Tem Vance made a motion to award the contract for
the inspection of the park construction to Nelson Corporation
as recommended by the Parks and Recreation Committee,
modify the contract to incorporate Mr. Hill's comments in his
letter dated March 16, 1989, deleting paragraph "8" on page
2, delete paragraph's 2.3, 2.4 and 2.5 in the park contract
and change the phrase " the fee is based on a 120 day
contract" which appears on the front page of the contract to
"the fee is based on the duration of the contract". Council
Member Martignago seconded, motion carried unanimously.
Mayor Pro Tem Vance made a motion approving a Resolution
authorizing the Mayor to Execute a contract with the Nelson
Corporation to review and inspect the construction of Trophy
Club Park. Council Member Martignago seconded, motion carried
unanimously.
CONSIDERATION OF ORDINANCES: FIRST READING
TOWN COUNCIL TO CONSIDER AN ORDINANCE CONCERNING THE
CONSTRUCTION OF FENCES AND REPEALING ORDINANCES NO. 86-22,
87-17 AND 88-13. THIS ORDINANCE COMBINES ()1-J CURRENT
ORDINANCES DEALING WITH FENCE CONSTRUCTION, PERMITTING,
HEIGHT REQUIREMENTS AND OTHER REGULATIONS.
This ordinance will be on the April 4, 1989 agenda for second
reading.
Mayor Pro Tem Vance made a motion to adjourn, Council Member
Martignago seconded, motion carried unanimously.
