The Town Council of the Town of Trophy Club met in regular
session on Monday, October 29, 1990. The meeting was held at
the Municipal Utility District Building, 100 Municipal Drive,
and was open to the Public.

Mayor Carter called the meeting to order at 7:00 p.m.
INVOCATION
Council Member Vance gave the Invocation.
PLEDGE OF ALLEGIANCE
Treasurer Jack Jacobs led in the Pledge of Allegiance.
CONSIDERATION OF MINUTES
Mayor Pro Tem Doran made a motion to approve the minutes of
the October 24th meeting, Council Member Vance seconded,
motion with Council Member Hill abstaining. He was not in
attendance.
Council Member Vance made a motion to approve the minutes of
the October 15th meeting, Council Member Hill seconded,
motion carried unanimously.
Council Member Hill made a motion to approve the minutes of
the October 15th Public Hearing, Mayor Pro Tem Doran
seconded, motion carried unanimously.

TOWN ATTORNEY TO REPORT TO THE COUNCIL ON HIS INVESTIGATION
REGARDING THE DEDICATION OF LAND FOR AN ENTRANCE FROM TROPHY
WOOD DRIVE TO KIRKWOOD DRIVE.
Mr. Bartholow reviewed correspondence between Mr. John Hardy,
of Hardy & Atherton law firm, and Mr. Todd Moore, of Gardere
and Wynne. Mr. Bartholow reported to the Council that
although Hartwell and Mr. Gaubert are supportive of the
Town's request, it is reasonable to believe no serious
consideration will be given until the reorganization plan for
Hartwell land is underway.
MR. WALT WOOD, CHAIRMAN OF THE PUBLIC WORKS COMMITTEE TO
REPORT THE COMMITTEES FINDINGS REGARDING THE COST OF A
TEMPORARY/PERMANENT ROAD FROM TROPHY WOOD DRIVE TO KIRKWOOD
DRIVE.
Mr. Wood, Chairman of the Public Works Committee, reviewed
costs estimates prepared by Teague, Nall & Perkins
engineering firm regarding a temporary/permanent road. The
report is filed with the minutes of this meeting.
CITIZENS COMMENTS REGARDING THE TROPHY WOOD ENTRANCE
Mr. Jim Thomas commented that the "Slow Children At Play"
sign would be more effective if placed closer to the "30 Mile
Per Hour" sign.
Mr. Jack Jacobs, 101 Pebble Beach, pointed out that the
property being discussed was zoned commercial. Mr. Jacobs
pointed out that if the property were sold or developed, the
developer would have to build the permanent road to Town
standards.
Mayor Pro Tem Doran stated it would be prudent to consider
only a temporary road at this time.
Council Member Vance suggested investigating the Town's
options with the County and determine if they can participate
by providing the labor to build the temporary road.
Council Member Hill noted that the first step was to address
funding. The Town does not have the funds at this time. He
suggested having the Finance Committee address the issue of
funding.
Council Member Engelbeck stated that he was opposed to
funding the road. He felt this would go against the Town's
policy of having the developer do improvements to
property.

Council Member Sylvia stated the general consensus seems to
not to start a precedent for funding roads but he noted that
the Council still needs to address the problems with Skyline
and provide an east entrance.
The general consensus of the Town Council was to continue the
investigation concerning the road.
PRESENTATIONS BY CITIZENS
Mr. Bob Moore, 7 Skyline Drive, stated that the Council is
condoning trespassing on private property.
Town Attorney, Toby Bartholow, stated that trespassing is
subject to the owners consent and trespassing has to be
enforced in the presence of a law enforcement officer in
order to be enforced.
Mr. Bob Clinkenbeard, 119 Fairway Village Drive, stated that
a real estate sign had been taken from his yard by the Town
staff. Mr. Clinkenbeard stated he did not know he was not in
compliance with the sign ordinance. He requested the sign be
returned and new policies of enforcement be adopted such as
notifying the homeowner first.
Mr. Jack Alford, 3 Skyline, commended the Council on how
willing they have been to listen to the concerns of the
residents of Skyline regarding the entrance. Mr. Alford urged
the Council to keep pursuing an alternative route.
Mr. Ragi Koshy, 5 Skyline, asked the Council to keep pursuing
the Skyline problems. He noted that he has a seven year old
son and believes that Skyline is a dangerous road.
Mr. Jim Thomas, 7 Mwadowbrook Lane, noted that in the last
several years, the "unauthorized entrance" has moved four
times. He stated that if the entrance is barricaded the
barricade would have to be 310 yards long. Mr. Thomas told
the Council he drove his car across several adjacent areas
and was able to cross to T.W. King.
Mr. Len Kopell, 6 Skyline Drive, stated a dog was hit in
front of his child on Skyline and the car was going 40 or 50
miles per hour. He also stated using the entrance was a bad
example for children because it condones trespassing. Mr.
Coppell asked the Council to consider an ordinance
prohibiting crossing lots at an unauthorized entrance.

PRESENTATIONS BY COUNCIL
Council Member Engelbeck stated that Trophy Club had received
"bad coverage" from an article in "D" magazine. Mayor Carter
stated he would call the magazine.
Mayor Pro Tem. Doran apologized to not giving a list of
violations to the staff as promised at the September meeting.
He stated he would turn over the list to the staff after
tonight's meeting. He noted that even though Ms. Shaw did not
have the list to work from, several of the items were already
addressed.

The Committee/Staff reports are filed with the minutes of
this meeting.
FINANCIAL REPORTS
Council Member Vance made a motion to approve the September
financial report as presented, Mayor Pro Tem Doran seconded,
motion carried unanimously.
CONSIDERATION OF ORDINANCE: FIRST READING
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROVIDING A
TEMPORARY MAXIMUM RATE OF SPEED ON SKYLINE DRIVE.
This ordinance will be on the next agenda for second reading.
TOWN COUNCIL TO CONSIDER AMENDING ORDINANCE NO. 90-12
CONCERNING SATELLITE DISHES.
Council Member Engelbeck made a motion to let Ordinance No.
90-12 and 90-16 concerning satellite dishes stand as written.
Council Member Sylvia seconded, motion carried unanimously.
TOWN COUNCIL TO CONSIDER A LAW ENFORCEMENT LIABILITY POLICY
AS RECOMMENDED BY THE ADMINISTRATIVE COMMITTEE.
Council Member Sylvia made a motion to approve the Law
Enforcement Liability Insurance as presented, Council Member
Hill seconded, motion carried unanimously.
