Minutes TC 09/24/1990MINUTES OF TOWN COUNCIL MEETING TOWN OF TROPHY CLUB SEPTEMBER 24, 1990 THE STATE OF TEXAS ) ) COUNTY OF DENTON ) The Town Council of the Town of Trophy Club met in regular session on Monday, September 24, 1990. The meeting was held at the Municipal Utility District Building, 100 Municipal Drive, and was open to the Public. Jim Carter Mayor George Doran Mayor Pro Tem Marshall Engelbeck Council Member Bob Sylvia Council Member Terry Vance Council Member Absent: Council Member Hill and Treasurer Jack Jacobs. Also present were members of the Town staff: Toby Bartholow Attorney Pauline Shaw Code Enforcement Donna Welsh Town Administrator CALL TO ORDER Mayor Pro Tem Doran called the meeting to order at 7:00 p.m. INVOCATION Council Member Vance gave the Invocation. PLEDGE OF ALLEGIANCE Council Member Sylvia led in the Pledge of Allegiance. CONSIDERATION OF MINUTES Council Member Vance made a motion to approve the minutes of the August 21, 1990 meeting as written. Council Member Engelbeck seconded, motion carried unanimously. Mayor Carter joined the meeting at 7:05 p.m. Council Member Sylvia made a motion to approve the minutes of the September 11, 1990 meeting as written, Council Member Vance seconded, motion carried unanimously. Page 2 CONSTABLE JOHN HATZENBUHLER TO ADDRESS THE COUNCIL Constable Hatzenbuhler informed the Council of the various duties his office performs. He also introduced Deputy Bill Madding who is the litter abatement officer. Deputy Madding performed magic tricks which he uses in teaching children about litter control. COMMITTEE REPORTS The committee reports are filed with the minutes of this meeting. STAFF REPORTS [he staff reports are filed with the minutes of this meetinc Mr. Marion Jenkins, Marshal for the Town, offered his resignation as of September 13th. Mr Jenkins told the Council he is extremely busy with a new job venture and it would be difficult to find the time to complete his certification which is required for the job. The Council thanked Mr. Jenkins for his hard work and dedication and presented him with a gift. FINANCIAL STATEMENl Council Member Sylvia made a motion to approve the financial statement for the month of August, Council Member Engelbeck seconded, motion carried unanimously. CONSIDERATION OF ORDINANCES A) AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING AND APPROVING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1990 AND TERMINATING SEPTEMBER 30, 1991, AND MAKING APPROPRIATIONS FOR EACH DEPARTMENT, PROJECT AND ACCOUNT; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS AND SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. Council Member Vance made a motion to approve the ordinance as written, Mayor Pro Tem Doran seconded, motion carried unanimously. Pane 3 B) AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS LEVYING MUNICIPAL AD VALOREM TAXES FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1990 AND ENDING SEPTEMBER 30, 1991, AND FOR EACH FISCAL YEAR THEREAFTER UNTIL OTHERWISE PROVIDED, AT A RATE 01::-- $.2495 F$.2495 PER ONE HUNDRED DOLLARS ($100.00) ASSESSED VALUATION ON ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE TOWN AS OF JANUARY 1, 1990. Council Member Sylvia made a motion to approve the ordinance as written, Mayor Pro Tem Doran seconded, motion carried unanimously. C) AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS CREATING A POLICE DEPARTMENT; PRESCRIBING THE POWERS AND DUTIES OF THE CHIEF OF POLICE AND POLICE OFFICERS OF THE TOWN; CREATING A RESERVE POLICE FORCE; ABOLISHING THE OFFICE OF THE TOWN MARSHAL AND CONFERRING THE DUTIES OF THE OFFICE OF TOWN MARSHAL ON THE CHIEF OF POLICE. Mayor Pro Tem Doran made a motion to approve the ordinance as amended, Council Member Engelbeck seconded, motion carried unanimously. TOWN COUNCIL TO CONSIDER AMENDING ORDINANCE NO. 0 90-12 DEALING WITH SATELLITE DISHES. Mayor Carter explained that at the previous meeting, the Council amended the screening and variance portion of the ordinance. The staff encountered problems with interpreting the new ordinance. The Council discussed the new screening requirement. The ordinance required the dish to be adequately screened from line of sight so that no more than two feet (2') of the dish is visible from the public. This penalized anyone living on a downhill slope from other properties. The Council asked Mr. Bartholow to review ordinances from other Town's concerning screening requirements to see how they are enforced. The Council also discussed the variance portion of the ordinance. This portion required any dishes not in compliance with the new ordinance to comply within six months. Mr. Bartholow pointed out that the Town might encounter problems if the owner of the dish has been given a variance in the past. Council Member Vance made a motion to amend section seven, striking the reference to dishes that have previously received a variance. Council Member Sylvia seconded. Page 4 Council Member Vance also made a motion to amend section 4, striking the words "visible to the public" and adding the words "visible from the street". The motion dies for lack of second. The Council then voted on the ordinance motion made by Council Member Vance. The motion was unanimous in favor of the amendment. TOWN COUNCIL TO CONSIDER A RESOLUTION APPROVING AND AWARDING A CONTRACT FOR LANDSCAPE MAINTENANCE OF PUBLIC AREAS WITHIN THE TOWN TO JASPER HAYES COMPANY, AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT. Mayor Pro Tem Doran made a motion to approve the Resolution awarding the contract to Jasper Hayes Company as recommended by the Public Works Committee. Council Member Vance seconded, motion carried unanimously. PRESENTATIONS BY CITIZENS Mrs. Barbara Alford, 3 Skyline Drive, addressed the Council concerning the unauthorized east entrance. Mrs. Alford stated this has become a safety hazard with several hundred cars a day using Skyline Drive to get to the entrance. Mayor Pro Tem Doran stated that Public Works would be happy to meet on an emergency basis and research the matter. The entrance will be discussed at the next regular meeting. PRESENTATIONS BY COUNCIL Council Member Vance suggested placing "Presentations by Citizens" near the beginning of the Council agenda for the convenience of the Citizens. The Council concurred. Mayor Pro Tem Doran stated that he had a twelve page list of ordinance violations he had documented with Mr. Tom Mathews on a recent drive around the Town, Mayor Pro Tem Doran stated he would have the list to the staff by the and of the week.
