The Town Council of the Town of Trophy Club, Texas met in
a regular session on Tuesday, December 5, 1885. The meeting
was held within the boundaries of the Town and was open to
the Public.

Mayor Pro Tem Hill called the meeting to order at 7:00 p.m.
noting a quorum was present. He then welcomed Council
Members, Quests, and staff.
INVOCATION.
An invocation was given by Town Attorney, John Hill.
PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAGS.
The pledge of allegiance to the American and Texas Flags was
led by Police Chief, David Miller,

TOWN COUNCIL TO CONSIDER THE ADOPTION OF AN ORDINANCE OF THE
TOWN OF TROPHY CLUB, TEXAS GRANTING TO TRI -COUNTY ELECTRIC
COOPERATIVE INC., ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC
LIGHT, HEAT' AND POWER FRANCHISE.
After Council Member Glmepell learned that this franchise
does not cause a conflict with the Texas Utility Electric's,
he made a motion to adopt the ordinance. Council Member
Engelbeck seconded; motion passed unanimously.
TOWN COUNCIL TO CONSIDER AN ORDINANCE OF THE TOWN OF TROPHY
CLUB, TEXAS ADOPTING THE UNIFORM BUILDING CODE, 1894 EDITION
AND ALL APPENDICES THERETO, AS AMENDED BY THE TERNS OF THIS
ORDINANCE; ADOPTING THE UNIFORM FIRE CODE, 1994 EDITION, AS
AMENDED HEREIN; ADOPTING THE UNIFORM MECHANICAL CODE, 1994
EDITION, AS AMENDED HEREIN; ADOPTING THE UNIFORM PLUMBING
CODE, 1984 EDITION, AS AMENDED HEREIN; ADOPTING THE UNIFORM
ADMINISTRATIVE CODE, 1894 EDITION; ADOPTING THE NATIONAL
ELECTRICAL CODE, 1893 EDITION; PROVIDING THAT ALL COMMERCIAL
MOTOR VEHICLES DOING BUSINESS WITHIN THE TOWN SHALL HAVE
IDENTIFYING MARKINGS; PROVIDING A SAVINGS CLAUSE, BUT
REPEALING ORDINANCE NO. 92-04 RELATING TO THE ADOPTION OF
EARLIER VERSIONS OF THE UNIFORM C0UE8'' PROVIDING A
SEVERABILITY CLAUSE', PROVIDING A PENALTY NOT TO EXCEED THE
SUM OF TWO THOUSAND DOLLARS ($ 2,800.00) FOR EACH OFFENSE AND
A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING
OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN
EFFECTIVE DATE.
As no discussion ensued, Council Member Engelbeck made a
motion to adopt the ordinance as stated. Council Member
Stoltz seconded; motion passed unanimously.
TOWN COUNCIL TO CONSIDER AN ORDINANCE OF THE TOWN OF TROPHY
CLUB, TEXAS ADOPTING A SCHEDULE OF FEES FOR THE TOWN,
INCLUDING FEES FOR BUILDING PERMITS, REVIEW OF PLANS,
ELECTRICAL' MECHANICAL, FENCE AND TREE PRESERVATION PERMITS,
REINSPECTION, CERTIFICATE OF OCCUPANCY, CONSTRUCTION IN
RIGHT- 0E -NAY AND COPIES OF TOWN ORDINANCES, RESOLUTIONS AND
OTHER TOWN RECORDS AND DOCUMENTS; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE
DATE.
After Council Member Stoltz learned from Council Member
EDgelbeck that these fees were a b to 7% difference from the
former fees, Council Member EngelbeCk made a motion to adopt
the new fees schedule. Council Member 8laspell seconded;
motion passed unanimously.
TOWN COUNCIL TO CONSIDER THE ADOPTION OF A RESOLUTION OF THE
TOWN OF TROPHY CLUB, TEXAS APPROVING AND INTERLOCAL
COOPERATION AGREEMENT BY AND BETWEEN THE TOWN AND DENTON
COUNTY TO PROVIDE EMERGENCY AMBULANCE SERVICES FOR AREAS IN
DENTON COUNTY; AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT;
PROVIDING AN EFFECTIVE DATE.

Since this contract is the same as last year's, Council
Member Glaspell made a motion to approve the interlocal
agreement with Denton County. Council Member Stoltz
seconded; motion passed unanimously.
Before moving to agenda item 8, Hap and Deborah Baggett of
Synergy Properties, Inc. presented a $ 2,000.00 contribution
to the Town's Teen Court project. Mr. Baggett was involved
with one of the first Teen Court's in Texas, and both he and
his wife strongly endorse community involvement.
TOWN COUNCIL TO CONSIDER THE ADOPTION OF A RESOLUTION OF THE
TOWN OF TROPHY CLUB, TEXAS APPROVING AN INTERLOCAL AGREEMENT
FOR A TEEN COURT PROGRAM BETWEEN THE TOWN AND THE CITIES OF
KELLER, WATAUGA, AND THE INDEPENDENT SCHOOL DISTRICTS OF
KELLER, BIRDVILLE, AND NORTHWEST; AUTHORIZING THE PAYMENT OF
$ 2,000.00 FOR THE TEEN COURT PROGRAM FOR THE TOWN'S
MUNICIPAL COURT; PROVIDING AN EFFECTIVE DATE.
Council Member Engelbeck reminded the Council of the 1 year
trial commitment and thanked Mr. and Mrs. Baggett for their
generous donation.
Council Member Stoltz then made a motion to adopt the
resolution. Council Member Glaspell seconded; motion passed
unanimously.
TOWN COUNCIL TO CONSIDER THE ADOPTION OF A RESOLUTION OF THE
TOWN OF TROPHY CLUB, TEXAS ARTICULATING THE TOWN'S INTENT TO
PROHIBIT THE CARRYING OF CONCEALED HANDGUNS ON TOWN -OWNED
PREMISES; DIRECTING THE TOWN MANAGER TO POST THE APPROPRIATE
NOTICE THAT POSSESSION OF A CONCEALED HANDGUN ON TOWN -OWNED
PREMISES IS FORBIDDEN; AUTHORIZING THE TOWN MANAGER TO TAKE
THOSE STEPS REASONABLE AND NECESSARY TO DENY ENTRY ONTO TOWN -
OWNED PREMISES BY PERSONS CARRYING CONCEALED HANDGUNS;
PROVIDING AND EFFECTIVE DATE.
It was established that this is a preliminary step and that
the State has to perfect any loopholes, but it is needed for
the protection of the staff from irate citizens.
After Council Member Glaspell noted that we are tenants and
need the M.U.D.'s support, he made a motion to adopt the
resolution to prohibit concealed handguns. Council Member
Engelbeck seconded; motion passed unanimously.
TOWN COUNCIL TO CONSIDER THE ADOPTION OF A RESOLUTION OF THE
TOWN OF TROPHY CLUB, TEXAS EXEMPTING CERTAIN POLICE VEHICLES
FROM THE REQUIREMENT THAT TOWN VEHICLES HAVE PRINTED ON EACH
SIDE THE TOWN'S NAME; AUTHORIZING THE POLICE DEPARTMENT TO
ACQUIRE EXEMPT LICENSE PLATES FOR CERTAIN POLICE VEHICLES AND
TO OBTAIN AN ALIAS REGISTRATION FOR SUCH VEHICLES; PROVIDING
AND EFFECTIVE DATE.
Because this is only a change in the State law, Council

Member 8leopall made a motion to adopt the resolution.
Council Member Stoltz seconded; motion passed unanimously.
TOWN COUNCIL TO CONSIDER APPROVING A PARK FACILITIES
AGREEMENT FOR THE USE OF HARMONY PARK BETWEEN THE TOWN AND
THE TROPHY CLUB ATHLETIC ASSOCIATION.
The Council concurred that an agreement would allow better
control of park usage and encourage more responsibility from
the Athletic Association.
Council Member 8laspell then made a motion to approve this
much needed agreement. Council Member EngelbeCh seconded;
motion passed unanimously.
CONSENT AGENDA
Council Member EnBelbeck made a motion to accept the Consent
Agenda as is. Council Member Stoltz seconded; motion passed
unanimously with Council Member 8laapell abstaining from item
B due to his absence from that meeting.
The approved items are as follows:

B. Minutes of Joint Public Hearing/Town Council/
Planning and Zoning Commission 11/02/95
C. Financial reports ending October 31/ 1895.
TOWN COUNCIL TO DISCUSS PARLIAMENTARY LAW AND PROCEDURE.
Due to Mayor Carter's absence and request for this agenda
item` the Council asked to table this item on Robert's Rules
of Order to the January agenda.
CLOSED -DOOR SESSION: TOWN COUNCIL TO CONDUCT A CLOSED -DOOR
SESSION IN ACCORDANCE WITH CHAPTER 551, GOVERNMENT CODE,
VERNON'S TEXAS CODES, ANNOTATED (OPEN MEETINGS LAW), SECTION
551.074 PERSONNEL.
A. TO CONSIDER THE APPOINTMENT OF MEMBERS TO THE
ZONING BOARD OF ADJUSTMENTS COMMISSION.
Town Council adjourned into Closed -door Session at 7:23 p.0.
to discuss and consider item A.
Planning and Zoning Administrator, Pauline Shaw, explained
that alternates are needed because the Board meets so
infrequently and a quorum is mandatory when it does meet.
Five names were considered for the appointments.

RECONVENE INTO OPEN SESSION: TOWN COUNCIL TO RECONVENE INTO
REGULAR SESSION TO TAKE NECESSARY ACTION REGARDING THE
MATTERS DISCUSSED IN CLOSED -DOOR SESSION PURSUANT TO AGENDA
ITEM A.
The Council reconvened into open session at 8:35 p.m. and
took no action on the appointments.
*PRESENTATIONS BY CITIZENS
Constable John Hatzenbuhler asked for support of his re-
election as constable and presented his accomplishments over
the past four years. He reminded everyone that early voting
begins March 1-2, 1980.
STAFF AND COMMITTEE REPORTS
Planning and Zoning Administrator, Pauline Shaw, announced
128 new housing starts between January and November worth
over 21 million dollars.
Police Chief Miller reported that the Public Safety Committee
was conducting another traffic study on Inverness Drive.
Public Works Director, Bill Le8rand. said Phase III bide for
the street repairs will be opened January 3, 1998. Phase II
of street sealing will be Completed by mid December.
Town Manager Welsh informed the Council that the Texas
Department of Transportation is sending engineers to aSagaG
the unsafe intersection at Highway 114 and Trophy Lake Drive.
PRESENTATIONS BY COUNCIL
Council Member Stoltz commented how pretty the C.I.A. Holiday
Tree Lighting was and how the citizens enjoyed it.

$4A Corporation (business development)
1. Because Trophy Club is located in a county with less than 500,000 population,
the Town may create a corporation to encourage economic development (the promotion and
development of new and expanded business enterprises)
2. Corporation has articles, bylaws, etc., and the members of the board (5 directors)
are appointed by the Council and serve at the pleasure of the Council.
3. Town may call an election to establish a sales tax (rate may be 1/8, 1/4, 3/8 or
1/2 of 1 %) to be used by the corporation for business development (sales tax rate limited such
that rate imposed by all political subdivisions having jurisdiction within the Town does not
exceed 2 %)
4. Election --may allow the voters to vote on a proposition that limits the period the
tax may be imposed, or may limit the tax to a specified project
5. Corporation may issue bonds
6. "Projects" corporation may perform include the land, buildings, equipment,
facilities, and improvements found by the board of directors to be required or suitable for the
promotion of development and expansion of manufacturing facilities, transportation facilities,
sewage or sold waste disposal facilities, recycling facilities, air or water pollution control
facilities, water facilities, small warehouse facilities, etc.

1. Generally, same authority as above (e.g. may issue bonds)
2. Tax rate which may be imposed is the same, and may only be imposed after
approval by a majority of the voters.
3. Board of directors is composed of 7 members.
4. "Project" includes those items which a 4A corporation can spend money for, plus
land, buildings, equipment, facilities and improvements found by the board of directors to:
(a) be required or suitable for use for sports, athletic, entertainment, tourist,
convention, and public park purposes and events, including stadiums, ball parks, auditoriums,
amphitheaters, concert halls, learning centers, parks and park facilities, open space
improvements, municipal buildings, museums, exhibition facilities ... and related roads, streets,
and water and sewer facilities, and other related improvements to enhance any of those items;
or
(b) promote or develop new or expanded business enterprises, including a project to
provide public safety facilities, streets and roads, drainage and related improvements, demolition
of existing structures, generally municipally owned improvements, or other projects that
promotes or develops new or expanded business enterprises.
Costs of a publicly owned and operated project may include the maintenance and
operating costs of the project, unless petition submitted which requires election
