Minutes TC 10/07/1997MINUTES OF REGULAR TOWN COUNCIL MEETING TOWN OF TROPHY CLUB, TEXAS October 7, 1997 THE STATE OF TEXAS COUNTY OF DENTON The Town Council of the Town of Trophy Club, Texas met in a regular session Tuesday, October 7, 1997. The meeting was held within the boundaries of the Town and was open to the public. COUNCIL MEMBERS PRESENT: Jim Carter Marshall Engelbeek Doug Glaspell Kevin Carr COUNCIL MEMBERS ABSENT: Edwin "Ed" Decker Susan H. He then welcomed Council Members, guests and staff. An Invocation was given by David Miller, Director DPS. Page 2 Regular Session, Town Council, October 7, 1997 PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAG: The pledge of allegiance to the American and Texas Flags was led by Greg Guilluame, Senior Accountant. PRESENTATIONS BY CITIZENS: There were no presentations from citizens at this time. STAFF AND COMMITTEE REPORTS: Karen Sadri, Town Secretary, reported to the Council that there were 34 applicants for the 15 positions on the Home Rule Charter Commission and that the ballots had gone to the printers. Bill LeGrand, Director of Public Works, updated the Council on; the lawn watering machines purchased for watering the soccer field or any other fields that may need watering; the construction of Trophy Wood and Indian Creek Drives; the construction of the sidewalks on Village Trail and Trophy Lake and Trophy Club Drives; direction from the Council for the repair work on Skyline Drive, and the status of the demolition of the house at 241 Oak Hill Drive. Roger Unger, Manager, Municipal Utility District, updated the Council on EMS/FD/P.D. runs. There were no committee reports. Billy Hughes, Chairperson, Parks & Recreation Committee, thanked the Council for the watering machine for the soccer fields. TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS TO CONSIDER AND ADOPT AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROHIBITING MINORS UNDER SEVENTEEN YEARS OF AGE FROM BEING IN ANY PUBLIC PLACE BETWEEN THE HOURS OF 11:00 P.M. AND 5:00 A.M. ON WEEKDAYS, AND BETWEEN 12:01 A.M. AND 5:00 A.M. ON WEEKENDS; PROVIDING DEFINITION; PROVIDING CERTAIN DEFENSES TO THE SAID PROHIBITION AND FOR ENFORCEMENT OF THE PROHIBITION; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE: The following citizens addressed the Council: Deborah Holsworth Russ Puskar Lynn Gamron 11 10 Trophy Club Dr. 261 Oak Hill Dr. 6 Ross Ct. Following discussion, Council Member Carr moved to table this item until the next regularly scheduled (October 21, 1997) Council meeting. Council Member Glaspell seconded; motion passed unanimously. Page 3 Regular Session, Town Council, October 7, 1997 TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS TO CONSIDER AND ADOPT A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS APPROVING A PARK FACILITIES AGREEMENT BETWEEN THE TOWN AND THE TROPHY CLUB ATHLETIC ASSOCIATIONS FOR USE OF CERTAIN ATHLETIC FIELDS UNDER THE TOWN'S CONTROL; AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT ON BEHALF OF THE TOWN; PROVIDING AN EFFECTIVE DATE: Following discussion Council Member Glaspell moved to accept the agreement with the following revisions: ► Rewrite the scheduling agreement, give the TCSA 24 hours notice of field use, if nothing previously scheduled. ► Change "owner" to "Town". ► Add "officials" to " officers, employees, etc." ► Exhibit "A"- 2 deemed necessary by the Town. ► Include Exhibit "B" in revised agreement. ► Correct the extension to 179. Council Member Carr seconded; motion passed unanimously. TOWN COUNCIL TO CONSIDER A VARIANCE TO ORDINANCE #95-16 (FENCE ORDINANCE) AT THE REQUEST OF: GARY McMICKLE OF 121 SEMINOLE DRIVE DAVE INGMIRE OF 202 CARNOUSTIE DRIVE This item was tabled at the request of the applicant, Ingmire. TOWN COUNCIL TO CONSIDER A VARIANCE TO ORDINANCE #95-22 (ROOFING ORDINANCE) AT THE REQUEST OF: KIRK NORBY OF DALWORTH TIlVIBEROOF This item was tabled because applicant was out of town. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING APPROVING EXPENDITURES FROM COURT SECURITY REVENUES (LINE ITEM 00-4221) TO CONSTRUCT A SECURED RECEPTIONIST AREA IN THE FRONT FOYER: Following discussion, Council Member Glaspell moved to approve expenditures from Court Security Revenues (line item 00-4221) to construct a secured receptionist area in the front foyer, provided it included a security barrier and locking device to protect the Court Clerk. Mayor Pro Tem Engelbeck seconded; motion passed unanimously. Page 4 Regular Session, Town Council, October 7, 1997 TOWN COUNCIL TO DISCUSS "ROCKFEST `97" AND ITS EFFECTS ON THE CITIZENS AND RECEIVE ANY UPDATES. (MAYOR CARTER): Following discussion, no action taken. DISCUSSION AND APPROPRIATE ACTION REGARDING THE TOWNS PURCHASING POLICIES. (MAYOR PRO TEM ENGELBECK): Mayor Pro Tern Engelbeck requested a formally written purchasing policy. TOWN COUNCIL TO DISCUSS THE "WEDDING CHAPEL" AND ITS EFFECTS ON THE CITIZENS AND RECEIVE ANY UPDATES. (COUNCIL MEMBER MCCABE): Following discussion, no action taken. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION (to give staff direction) REGARDING THE CITIZEN'S SURVEY RESULTS: Following discussion, staff suggested to put survey results into the newsletter and mail to the residents. CLOSED DOOR SESSION. TOWN COUNCIL TO CONDUCT A CLOSED SESSION IN ACCORDANCE WITH CHAPTER 551, GOVERNMENTAL CODE, VERNON'S TEXAS CODES, ANNOTATED (OPEN MEETING LAW), SECTION 551.074 PERSONNEL. A. APPOINTMENTS TO THE ZONING BOARD OF ADJUSTMENTS. Council adjourned into closed door session at 9:00 p.m. RECONVENE INTO OPEN SESSION. TOWN COUNCIL TO RECONVENE INTO REGULAR SESSION TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING THE MATTERS DISCUSSED IN CLOSED SESSION: Council reconvened into open session at 9:05 p.m. Mayor Pro Tem Engelbeck moved to appoint Bettye Dayton and Stuart Herigodt to the Zoning Board of Adjustments as alternates, or if needed as regular Commissioners. Council member Carr seconded; motion passed unanimously.
