Minutes TC 08/27/2001 - Special SessionMINUTES OF PUBLIC HEARING AND SPECIAL TOWN COUNCIL MEETING FOR THE TOWN OF TROPHY CLUB AUGUST 27, 2001 STATE OF TEXAS COUNTY OF DENTON The Town Council of the Town of Trophy Club, Texas met in Public Hearing and Special Session on Monday, August 27, 2001. The meeting was held within the boundaries of the Town and was open to the public. INVOCATION: Mr. Dennis Sheridan gave the invocation. PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAG: Mr. Gene Hill led the pledges. CITIZEN PRESENTATIONS: THIS IS AN OPPORTUNITY FOR CITIZENS TO ADDRESS THE COUNCIL ON ANY MATTER WHETHER OR NOT IT IS POSTED ON THE AGENDA. THE COUNCIL IS NOT PERMITTED TO TAKE ACTION ON OR DISCUSS ANY PRESENTATIONS MADE TO THE COUNCIL AT THIS TIME CONCERNING AN ITEM NOT LISTED ON THE AGENDA. THE COUNCIL WILL HEAR PRESENTATIONS ON SPECIFIC AGENDA ITEMS PRIOR TO THE COUNCIL ADDRESSING THOSE ITEMS. Mr. Pete Reinke of 3 Colonial addressed the Council. TOWN COUNCIL TO CONVENE INTO PUBLIC HEARING: The Council convened into the Public Hearing t 7:40 p.m. Page 2 SPECIAL SESSION August 27, 2001 PUBLIC HEARING TOWN COUNCIL TO CONDUCT A PUBLIC HEARING RELATIVE TO THE FOLLOWING: A. TOWN COUNCIL TO CONSIDER AND DISCUSS THE ADOPTION OF AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, REPEALING ORDINANCE NO. 0.88-21 ADOPTING AN EXEMPTION FROM THE TOWN'S AD VALOREM TAX FOR PERSONS 65 YEARS OF AGE OR OLDER IN THE AMOUNT OF 525,000.00; ESTABLISHING NEW PROVISIONS FOR AN EXEMPTION FROM THE TOWN'S AD VALOREM TAXES FOR PERSONS 65 YEARS OF AGE OR OLDER; INCREASING THE AMOUNT OF SUCH EXEMPTION TO S30,000.00; ESTABLISHING AN EFFECTIVE TAX YEAR DATE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A CUMULATIVE REPEALER CLAUSE; PROVIDING SAVINGS; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. No presentations were made. B. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING THE BUDGET FOR FISCAL YEAR OCTOBER 1 2001 TO SEPTEMBER 30 2002. No presentations were made. TOWN COUNCIL TO CLOSE PUBLIC HEARING: Town Council closed the Public Hearing at 7:42 p.m. TOWN COUNCIL TO RECONVENE INTO REGULAR SESSION: Town Council reconvened into Special Session at 7:42 p.m. SPECIAL SESSION TOWN COUNCIL TO CONSIDER AND ADOPT AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, REPEALING ORDINANCE NO. 0.88-21, ADOPTING AN EXEMPTION FROM THE TOWN'S AD VALOREM TAX FOR PERSONS 65 YEARS OF AGE OR OLDER IN THE AMOUNT OF 525,000.00; ESTABLISHING NEW PROVISIONS FOR AN EXEMPTION FROM THE TOWN'S AD VALOREM TAXES FOR PERSONS 65 YEARS OF AGE OR OLDER; INCREASING THE AMOUNT OF SUCH EXEMPTION TO S30,000.00; ESTABLISHING AN EFFECTIVE TAX YEAR DATE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A CUMULATIVE REPEALER CLAUSE; PROVIDING SAVINGS; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. Mayor Pro Tem Edstrom stated that this agenda item was rescheduled to have appropriate input and proposed a $10,000 exemption instead of $5,000. Council Member Matthai shared that the interest in tabling this issue was to gain additional information. Council Member Williams expressed that the Ways and Means Committee has concerns, is it meaningful enough? The Ways and Means Committee did not feel that they have sufficient information to predict future assessments. Council Member Williams stated that he would like to see the Ways and Means committee continue evaluating this process. Council Member Spence expressed concern that he wants to make sure that we are headed in the right direction Page 3 SPECIAL SESSION August 27, 2001 Council Member Huizenga expressed concern that we go forth in unity and would like to keep those residents in mind and come to a consensus and go forward. Mayor Smith agreed with Council Member Huizenga and agrees that the Ways and Means Committee should continue to monitor this in the future. Mayor Pro Tem Edstrom made a motion to approve the Ordinance with the change of increasing the exemption $10,000 with a total of $35,000. Council Member Huizenga seconded, motion carried unanimously. TOWN COUNCIL TO CONSIDER AND ADOPT AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING AND APPROVING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2001 AND ENDING SEPTEMBER 30, 2002, AND MAKING APPROPRIATIONS FOR EACH DEPARTMENT, PROJECT, OPERATION, ACTIVITY, PURCHASE, ACCOUNT AND OTHER EXPENDITURES; PROVIDING FOR EMERGENCY EXPENDITURES AND EXPENDITURES AS ALLOWED BY APPLICABLE STATE LAW; PROVIDING FOR FILING OF DOCUMENTS; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. Jim Buxton gave an overview of changes. Donna Welsh warned that she thinks that we need to be very conservative when we look at the tax cut. Council Member Spence stated that everyone's rates are increasing including the county and the school district. As the park is completed we should be able to manage with funds not spent on the park in the future. Jim Buxton explained that if curbside recycling does not go into effect, we should save $45,000 to $50,000. The Budget recap needs to be printed in the newspaper, put on the website and channel 7. Copies also need to be made to have for pick up at the MUD building. Council Member Matthai made a motion to approve the Ordinance as written. Mayor Pro Tem Edstrom seconded, motion carried unanimously. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING THE APPOINTMENT OF RUTLEDGE CRAIN & COMPANY P.C. AS THE TOWN'S AUDITORS FOR THE YEARS ENDING SEPTEMBER 30 2001 THROUGH SEPTEMBER 30 2004 AND EXECUTION OF THE ENGAGEMENT LETTER FROM SAME. Jim Buxton explained that from learning about GASB 34, Auditors are looking at GASB 34 as a difficult time in the future. Auditors will not take new clients without more than a three-year lead-time. This firm will help with the transition to the new finance director. Their fees are extremely reasonable. There is normally a 3-4% increase each year. Mayor Pro Tem Edstrom asked about a "not to exceed" for the 2°" year. Council Member Williams made a motion to table this agenda item to the September 17" meeting. Council Member Huizenga seconded; motion carried unanimously. ADJOURN.
