A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS AWARDING A CONTRACT FOR
THE CONSTRUCTION OF THE TROPHY CLUB PARK TO
M.W. HALPERN & CO.; AUTHORIZING AND
EMPOWERING THE TOWN MAYOR TO EXECUTE A
CONTRACT FOR THE PARK CONSTRUCTION WITH M.W.
HALPERN & CO.; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Trophy Club, Texas is empowered by
section 331.001; Tex. Loc. Gov. Code Ann. (Vernon) to acquire
land to be used for public park purposes and to improve such
land for such purposes; and
WHEREAS, the Town pursuant to such authority, has
heretofore acquired land for a public park; and
WHEREAS, the Town sought bids for construction of the
said park in accordance with the requirements of the State
competitive bidding law and other applicable laws; and
WHEREAS, several bids were timely submitted and, after
having reviewed the bids and having received the recommendation
of the Town Staff, the Town Council finds that the bid should
be awarded to the hereinafter named party, and finds that award
of the bid as provided for herein and the construction of the
public park is in the best interests of the health, safety and
welfare of the citizens of the Town.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
ordinance as if copied in their entirety.
Section 2. That, except as hereinafter provided, there
is hereby awarded to M.W. Halpern & Co. (hereinafter referred
to as "Contractor") the contract with the Town of Trophy Club,
Texas for the construction of the park property generally known
as the "Trophy Club Park." A true and correct copy of the
contract is attached hereto and incorporated herein for all
purposes. Provided, however, that notwithstanding any other
provision of this Resolution, the award of the said contract
shall be conditional upon and subject to the approval by the
State of Texas of an extension of time for construction of the
Trophy Club Park. Further, change orders to the contract as
generally reflected on the document attached hereto as Exhibit
"Blo are hereby approved and shall be executed immediately
follwing execution of the contract.

Section 3. That the Town Mayor shall be and is hereby
authorized and empowered to execute the said contract with
Contractor on behalf of the Town upon the aforementioned
approval of an extension of time for construction of the Trophy
Club Park by the State of Texas.
Section 4. That this resolution shall take effect from
and.after its date of passage as provided by law.
PASSED AND APPROVED by the Town Council of the Town of
`Trophy Club, Texas this the 9th day of December, 1989.
