WHEREAS, the Town of Trophy Club has recognized the need to
upgrade SH 114 to alleviate traffic congestion and provide for
future mobility; and
WHEREAS, the upgrading and construction of SH 114 to a
controlled access freeway was authorized by the State Highway and
Public Transportation Commission in Minute Order 86418, dated
October 28, 1987; and
WHEREAS, the Town of Trophy Club and the Town of Westlake were
parties to the above-mentioned Minute Order requiring the local
governments to assist in providing the right-of-way for the
upgrading and construction of SH 114:
NOW THEREFORE BE IT RESOLVED, that the Town of Trophy Club
recognizes that the Town of Westlake is acting in cooperation with
the Town of Trophy Club for the mutual benefit of the residents of
the municipality; and
BE IT FURTHER RESOLVED, that the Town of Westlake is named the
agent of the Town of Trophy Club for the purpose of acquiring the
necessary right-of-way, in this instance the property known as
Parcels 3; 8, 9, Part 1; 9E, Part 1; 9 Part 2; 9E, Part 2; and 12
shown on the attached map; and
BE IT FURTHER RESOLVED, that the Town of Trophy Club consents
to the condemnation of the above referenced Parcels, if necessary.
