U, TOWN OF TROPHY CLUB, TEXAS RESOLUTION NO. 91- 04 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS FINDING A NECESSITY TO PROCURE TWO (2) POLICE CARS TO PRESERVE AND PROTECT THE PUBLIC HEALTH AND SAFETY OF THE RESIDENTS OF THE TOWN AND AUTHORIZING, APPROVING, RATIFYING AND CONFIRMING fie, CONTRACT FOR PURCHASE OF SAID POLICE CARS WHEREAS, by Ordinance No. 90-15 , enacted September 24, 1990, the Town established a Police Department and delegated to the Chief of Police the responsibility and authority to organize and administer the Department; WHEREAS, in furtherance of said authority, the Chief of Police has undertaken to hire police officers and procure materials and equipment necessary to enable the Department to fulfill its duty to preserve and protect the public safety of the residents of the Town; WHEREAS, the Town's contract with Denton County, Texas for police protection expired September 30, 1990; WHEREAS, the Town, based on information which the Chief of Police, the Town Administrator and the Town Council reasonably believed to be reliable, understood that satisfactory used police cars were immediately available for procurement from the State of Texas for use by the Department; WHEREAS, the Chief of Police made diligent effort to locate and procure satisfactory used police cars and, in so doing, determined that all available cars were in such a state of deterioration or disrepair as to be wholly unacceptable to the Town; WHEREAS, the unexpected unavailability of acceptable used police cars, coupled with expiration of the Town's contract with Denton County for police protection, made it necessary for the Town to take prompt action to procure police cars in order to provide police protection to residents of the Town so as to preserve and protect their public safety, and the Mayor, acting on behalf of the Town, therefore entered into contracts (the "Purchase Contracts") with Jack Williams Chevrolet; Inc., each dated September 28, 1990, to purchase two (2) 1991 Chevrolet Corsica police cars for $11,898.86 and $11`,819.66 respectively, payable t$399.96 and $368.99 respectively per month for 36 months. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, as follows: JAN.09 '91 11:22 HUTCHISON PRICE BOYLE BROOKS TX AW5X0 Section 1. The preambles and recitals set forth above are found to be true and correct and are incorporated into this resolution the same as if set forth verbatim herein. Section 2. The Town Council hereby finds and determines that the actions of the Mayor in acquiring police cars and entering into the Purchase Contracts are necessary to preserve and protect the public safety of the residents of the Town. Section 3. The procurement of the police cars and execution of the Purchase Contracts by the Mayor are hereby in all respects authorized, approved, ratified and confirmed.
