RESOLUTION NO. 92-n2
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS APPROVING AND ADOPTING
AN ENGINEERING SERVICES AGREEMENT BETWEEN THE
TOWN AND YANDELL & HILLER, INC. FOR THE
PURPOSE OF CONDUCTING A DRAINAGE STUDY ALONG
MARSHALL CREEK AND GOLF COURSE CREEK;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Trophy Club, Texas
has, pursuant to the terms of the Texas Professional Services
Procurement Act, article 664-4, V.T.C.S., heretofore sought the
professional services of an engineer to perform a drainage study
along Marshall Creek and Golf Course Creek located within the Town;
and
WHEREAS, the Town Council has concluded the Yandell & Hiller,
Inc. has demonstrated the competence and the qualifications to
conduct the said drainage study, and the Town Council now desires
to enter into a contract with Yandell & Hiller, Inc. to conduct the
study; and
WHEREAS, the Town Council hereby finds that the performance of
the drainage study as contemplated by the agreement is in the best
interests of the health, safety and welfare of the citizens of the
Town.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS:
Section 1. That the above and foregoing preamble is true and
correct and is incorporated herein as if copied herein in its
entirety.
Section 2. The Town Council of the Town of Trophy Club, Texas
does hereby approve and. adopt an Engineering Services Agreement
between the Town and Yandell & Hiller, Inc. for the purpose of
conducting a drainage study along Marshall Creek and Golf Course
Creek, as set forth in the Agreement. A true and correct copy of
the Agreement is attached hereto as Exhibit "A".
Section 3. That the Mayor of the Town is hereby authorized
and empowered to execute the Engineering Services Agreement on
behalf of the Town.
Section 4. That this Resolution shall take effect from and
after its date of passage.
