RESOLUTION NO. R 93-02
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS DECLARING THE TOWN'S
DISAPPROVAL OF THE ACTIONS TAKEN BY TARRANT
COUNTY TO RELOCATE THE DENTON/TARRANT COUNTY
LINE FROM ITS CURRENT POSITION; REQUESTING
THAT THE TARRANT COUNTY COMMISSIONERS COURT
REFRAIN FROM ANY FURTHER ACTION WITH RESPECT
TO RELOCATING THE SAID LINE; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Town of Trophy Club, Texas (the "Town") was
incorporated on January 19, 1985 in accordance with State law; and
WHEREAS, the boundaries of the Town as incorporated, and as
they exist today, lie adjacent to the Denton/Tarrant County line
(the "County line"); and
WHEREAS, all interested parties, including Tarrant and Denton
Counties, have for many years accepted and agreed upon the location
of the County line; and
WHEREAS, the agreed upon location of the County line places
the boundaries of the Town substantially within Denton County; and
WHEREAS, Tarrant County has recently re -raised a question
regarding the proper location of the County line and has taken an
adversarial posture against those parties who accept the County
line as it has historically been located; and
WHEREAS, the Tarrant County Commissioner's Court has
heretofore accepted and approved a surveyor's report which seeks to
establish a new northeast corner of Tarrant, which corner, if
connected to the northwest corner of Tarrant County, would result
in a substantial part of the Town being located in Tarrant County;
and
WHEREAS, the Town recognizes that confusion and hardship to
its citizens would occur if the Town is further split between two
counties, including the appraisal of property by separate appraisal
districts, the filing of documents affecting real property, voter
registration, appeals from the Municipal Court, and an increase in
the ad valorem tax rate for land relocated from Denton to Tarrant
County; and
WHEREAS, to allow an increase in the ad valorem tax rate would
be to unduly burden the land without providing the owners of that
land notice and an opportunity to respond to and appeal from the
increase as guaranteed by the Texas Tax Code; and
a
WHEREAS, the Town Council finds that the passage of this
Resolution is in the best interests of the health, safety and
welfare of the citizens of the Town.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS:
Section 1. That the above and foregoing preamble is true and
correct and is incorporated into the body of this Resolution as if
copied herein in its entirety.
Section 2. The Town Council opposes any relocating of the
Denton/Tarrant County line, and finds that a relocation of the
County line which further divides the Town between Denton and
Tarrant Counties is against the best interests of the health,
safety and welfare of the citizens of the Town.
Section 3. The Mayor is hereby directed and empowered to
cause copies of this Resolution to be delivered to the Tarrant and
Denton County Commissioners' Courts and all other parties
interested in the location of the Denton/Tarrant County line.
Section 4. That this Resolution shall take effect from and
after its date of passage.
PASSED AND APPROVED by the Town Council of the Town of Trophy
Club, Texas this the 19th day of January, 1993. _
