RES 1995-06TOWN OF TROPHY CLUB, TEXAS A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, AMENDING RESOLUTION NO. 94-19 RELATING TO ACQUIRING RIGHT-OF-WAY FOR PUBLIC STREET (THE EXTENSION OF TROPHY WOOD DRIVE TO A POINT OF INTERSECTION WITH T.W. KING ROAD), UTILITY, AND ASSOCIATED MUNICIPAL PURPOSES, AND A TEMPORARY EASEMENT FOR CONSTRUCTION PURPOSES, OVER, UNDER AND ACROSS THAT LAND DESCRIBED HEREIN, BY PROVIDING THAT THE ACQUISITION OF THE LAND FOR SUCH PURPOSES SHALL BE IN FEE SIMPLE; PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. Resolution No. 94-19 of the Town of Trophy Club is hereby amended by amending Section 2 thereof so that it shall hereafter read as follows (additions are underlined; deletions are str--uck through): "Section 2. The Town Council hereby finds and determines that it is necessary for the welfare of the Town and its citizens and is in the public interest to acquire fee simple title a perpetual easement in, over, under and across the tract of land described in Exhibit "A" attached hereto and incorporated herein for right-of-way for street, utility and associated municipal purposes, and to acquire a temporary construction easement (for the construction of the said street right-of-way) over and across the tract of land described in Exhibit "B" attached hereto and incorporated herein (the said tracts of land are hereinafter referred to together as the "Property"). Section 2. This Resolution shall take effect immediately from and after its date of adoption. Henry Survey, Abstract 528, Denton County, Texas, and being part of a 5.9439 acre tract as described in a deed filed in Volume 1385, Page 968, in addition to a part of a 307.91 acre tract as described in deed filed in Volume 676, Page 153, both of Denton County Deed Records, and being more particularly described as follows: COMMENCING at the northeast corner of said 5.9439 acre tract, said point also being the southeast corner of Lot 721, Trophy Club Section 9 as shown on plat recorded in Volume 16, Page 17, P.R.D.C.T., and lying on the west right-of- way line of County Road No. 3088 (T. W. Henry Survey, Abstract 528, Denton County, Texas, and being part of a 4.2356 acre tract as described in a deed filed in Volume 1385, Page 970, Denton County Deed Records, and being more particularly described by metes and bounds as follows: BEGINNING at the northeast corner of said 4.2356 acre tract, said point also being the intersection of the centerline of Trophy Wood Drive with the northerly property line of said 4.2356 acre tract of land; THENCE southerly along a 435.65 foot radius curve which bears to the right through a central angle of 12°13'36" for a distance of 92.96 feet to a point on a non -tangent non -concentric 173.43 foot radius curve which bears to the right; THENCE northerly along the arc of said curve through a central angle of 32°08'25" for a distance of 97.29 feet to a point on the northerly property line of the aforementioned 4.2356 acre tract; THENCE non -tangent to said curve and along the northerly property line of said 4.2356 acre tract, S 67°53'17" E, 36.50 feet to the POINT OF BEGINNING and containing 0.0522 acres or 2,272.77 square feet of land, more or less.
