A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS GRANTING A
PETITION FOR THE INCLUSION OF CERTAIN LAND
INTO TROPHY CLUB MUNICIPAL UTILITY DISTRICT
NO. 2.; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Donna Leispic has filed with the Town of Trophy Club, Texas (the
it a Petition requesting the Town's consent that certain land comprising approximately
11.589 acres ( acres (the "Land"), a metes and bounds description of
which is attached hereto as Exhibit A and incorporated herein, be included in and annexed into
the Trophy Club Municipal Utility District No. 2 (the "District"); and
WHEREAS, Donna Leispic has represented in her Petition that she is the sole owner of
the Land, which Land is located adjacent and contiguous to property presently located within the
geographical boundaries of the District; and
WHEREAS, the District has provided, at its own expense, and now owns, operates, and
maintains, facilities for processing and distributing a supply of surface water and subsurface
water and at the present time is qualified to furnish and deliver treated water to the area
contained within the District; and
WHEREAS, the District has heretofore received a petition from Donna Leispic
requesting annexation of the Land, and the District has expressed its desire to annex the Iand;
and
WHEREAS, it is deemed to be in the best interest of both the Town and Donna Leispic
that the Land be annexed into the District so as to have a supply of treated water to the Land
and sanitary sewer services available to the Land; and
WHEREAS, the granting of the Petition will result in providing more orderly
development and use of the Land and will promote and protect the general health, safety, and
welfare of the citizens of the Town of Trophy Club.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. Incorporation of premises. That the premises set forth above are true and
correct and are incorporated herein and made a part hereof for all purposes.
Section 2. Approval of Petition, Attached to this Resolution and made a part hereof
is a Petition requesting the Town of Trophy Club's consent that the Land described in Exhibit I
attached hereto and incorporated herein be included in the Trophy Club Municipal Utility
District No. 2. The said Petition is hereby approvedd and granted.

Section 3. Effective date. This Resolution shall take effect from and after its date of
adoption.

PETITION TO ANNEX CERTAIN LAND INTO
THE TOWN OF TROPHY CLUB
STATE OF TEXAS
COUNTY OF DEN£ON
TO THE TOWN COUNCIL, OF THE TOWN OF TROPHY CLUB, TEXAS:
The undersigned ("Petitioner") is the owner of title to land more particularly
described in the attached Exhibit 1 (the "Property") which is located within Denton
County, Texas. Acting pursuant to provisions of Section 43.428, Texas Loc. Gov. Code,
the undersigned respectfully petitions the Town Council of the Town of Trophy Club,
Texas (the "Town") to extend the present Town limits so as to include and annex as a part
of the Town the Property, and would respectfully show the following:

The Property is (i) one-half mile or less in width, (ii) contiguous to the 'Town, and
(iii) vacant and without residents or on which fewer than three qualified voters reside.
The Property is located entirely within the extraterritorial jurisdiction of the Town.

Petitioner is the sole owner of the Property, and this Petition is signed and
acknowledged by each and every person. (whether a corporation, limited liability company,
partnership, sole proprietorship, individual, or any other entity recognized in law) having
an interest in any part thereof

By this instrument, Petitioner hereby confirms, consents, and certifies that this
Petition to Annex constitutes a petition and election on the part of Petitioner, and its
successors and assigns in title to such property, for said land and any improvements
thereto, to the extent permitted by law, to be assessed for their share of all present and
future debts of the Town in the same manner and to the same extent as other lands and
improvements within the Town are liable for the Town's debts.

The undersigned officer and/or agent of Petitioner is the properly authorized
official and has the necessary authority to execute this Petition on behalf ofPetitioner, and
Petitioner hereby certifies to the Town that any necessary resolutions or other act
extending such authority have been duly passed and are now in full force and effect.
THEREFORE, Petitioner respectfuUy prays that this Petition be heard after due notice and
that the Town Council grants the Petition and institute annexation proceedings to annex the
Property into the Town.
