RES 1999-03RESOLUTION NO. 1999-03 A RESOLUTION AUTHORIZING THE PARTICIPATION OF THE TOWN OF TROPHY CLUB WITH OTHER TEXAS CITIES IN THE TEXAS COALITION OF CITIES FOR FRANCHISED UTILITY ISSUES; NAMING A REPRESENTATIVE TO THE STEERING COMMITTEE; AUTHORIZING PAYMENT OF A PARTICIPATION FEE AND PROVIDING AN EFFECTIVE DATE WHEREAS, market forces, technological changes, utility industry practices, and federal and state legislative and administrative body rulemaking have greatly impacted the ability of cities to maintain local control of land use decisions, city property, utility rate regulatory authority, and to preserve city revenue streams and a meaningful role for cities as a process participant; and WHEREAS, it is imperative that cities stay informed in these matters, and participate and work cooperatively to protect the interests of cities and the public; and WHEREAS, there exists among Texas cities a strong interest in participating in a common effort to protect these interests; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION 1. That the Town of Trophy Club agrees to participate with such other Texas cities in the Texas Coalition of Cities for Franchised Utility Issues ("Coalition"). Such coalition will (a) collect, analyze, discuss and distribute information on utility related matters; (b) participate and develop positions in utility regulatory body rulemaking dockets and on bills proposed in the legislature relating to utility matters; and (c) work cooperatively on matters relating to utility franchises and fee issues. SECTION 2. Cathy Morgas, or her designee may participate on the Coalition Committee and is authorized to receive notices concerning Coalition Committee activities at the following address: Name/Title: Cathy Morgas, Planning Director City/Address: 100 Municipal Drive, Trophy Club, Texas 76262 Telephone: (817) 430-1911 X173 SECTION 3. The Town authorizes payment to the Texas Coalition of Cities for Franchised Utility Issues of the participation fee. -1- Do ummt 4 679399 1. Name: The Task Force provided for herein shall be known as The Trophy Club Utility Franchise Task Force, and may be hereafter referred to as "the Task Force." 2. Members: The Task Force shall consist of (N/A) voting members to be named by the Town Council of the Town of Trophy Club s follows: a. One member of the Town Council b. One member of the Town Staff C. (N/A) individuals each of whom is a resident of Trophy Club who has a particular interest or experience in the issues of utility franchises. d. (N/A) members of the public works committee who will handle the overall maintenance and management of the agreements e. Legal Counsel 3. Chairman: The Council Liaison shall serve as Chairman of the Task Force; in the absence of the Council Liaison, a member of the Task Force will be appointed by the Council Liaison to serve as Chairman pro -tem. 4. Purpose: The Task Force shall: a. Undertake a fact-finding analysis intended to compile and assess the relevant issues and concerns associated with the management and maintenance of utility franchise agreements; b. Develop a recommendation regarding the most appropriate administration and enforcement of utility franchise agreements; and c. Prepare recommendations regarding the manner in which to implement new and/or renew franchise agreements which allows the city to maintain control of land use decisions and city property; maintain local rate regulatory authority and preserve Trophy Club's revenue streams to the extent the federal and state regulations allow. 5. Consultant/Professional Support: The Task Force shall be authorized to request and obtain the advice and professional consulting services of such consultants and professionals retained by the Town of Trophy Club as the Task Force shall deem necessary or useful in carrying out its purposes and obligations, subject to the prior approval of the Town Council in connection with the cost and funding of such consultants and professionals. 6. Final Report and Related Documents: The Task Force shall summarize and set forth the results of its fact-finding analysis and shall present summarize and set forth the results of its fact-finding analysis and shall present such information, together with its conclusions and recommendations, to the Town Council for review and comment and, thereafter, shall produce a Final Report.
