RES 1999-22RESOLUTION NO. 1999- 22 A RESOLUTION APPROVING THE REVISION OF RATES OF TRINITY WASTE SERVICES IN THE TOWN OF TROPHY CLUB, TEXAS; PROVIDING FOR CONDITIONS AND REPEAL OF CONFLICTING ORDINANCES. Whereas, on June 30, 1999 Trinity Waste Services (TWS) filed with the Town of Trophy Club a request for an increase in waste services to be charged within the Town in the amount of $ .39 per household; and Whereas, the Town, having suspended the effective date of such proposed increase until October 1, 1999, and having considered the same after reasonable notice and public hearing, is of the opinion and finds that the rates of TWS should be adjusted; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That the rates, tariffs, and charges of TWS for waste services within the Town be revised to be increased by $ .33 per household. Such Schedules of Rates, as are approved in accordance herewith, are those under which TWS shall be authorized to render waste services and to collect charges from its customers for rendering of waste services within the corporate limits of the Town until such time as said Rate Schedules may be changed, modified, amended, or withdrawn, with the approval of the Town Council. Section 2. That the rates approved hereby fix the overall revenues of TWS at a level which will permit TWS a reasonable opportunity to earn a reasonable return on its invested capital used and useful in rendering service to the public over and above TWS=s reasonable and necessary operating expenses. The rates approved hereby are just and reasonable. Section 3. That the rates approved hereby shall be effective and in force as a part of the services rendered as of the date hereof and shall be charged and observed thereafter until revised according to law. Section 4. That TWS shall file a Schedule of Rates and Tariffs setting forth those rates, tariffs, and charges based upon such increase in total operating revenues as prescribed herein. Such Schedule of Rates and Tariffs is attached. Section S. That any TWS request for modification of existing tariffs, rates or schedules not specifically addressed herein, including, but not limited to, the closure of certain tariffs, is denied. Section 6. That the action of the Town Council of the Town of Trophy Club enacting Town of Trophy Club Resolution 1999 Page 1 of 2 Q:ATOWNSEC\TRINITYW.REN.DOC this Ordinance constitutes, on the date of its final passage, a final determination of rates for TWS within the Town of Trophy Club. Section 7. That nothing contained in this Ordinance shall be construed now or hereafter as limiting or modifying, in any manner, the right and power of the Town under the law to regulate the rates and charges of TWS. Section 8. That all Ordinances, Resolutions, or parts thereof, in conflict herewith are repealed to the extent of such conflict. In addition, please call our office prior to delivery of any special waste to ensure that the materials are approved for acceptance. Load charges are based upon the full measured/rated capacity of the delivering vehicle or container in accordance with our policy.
