RESOLUTION NO. 1999- 30
A RESOLUTION REQUIRING THAT OPERATORS OF CABLE
SERVICES PAY A MINIMUM FEE OF FIVE (5%) PERCENT OF THE
ANNUAL GROSS REVENUE OF THE CABLE SYSTEM.
WHEREAS, the Town is empowered under Section 51.001 of the Texas Local
Goverment Code to adopt an ordinance or rule that is for the good government of the Town;
WHEREAS, the Town has a substantial interest in ensuring the proper management of
its public rights of way;
WHEREAS, the Cable Act of 1984 as amended permits municipalities to charge a
maximum franchise fee of five percent (5%) on cable operators;
WHEREAS, it is in the interest of the Town of Trophy Club to receive fair compensation
fur use of its public rights of way;
WHEREAS, cable operators receive a substantial and unique benefit in using the Town's
public rights of way;
WHEREAS, the Town Council has directed the Utility Franchise Task Force to seek
innovative solutions to manage the Town's public rights of way in an efficient manner.
WHEREAS, the Utility Franchise Task Force has recommended that the Town Council
pass a resolution requiring that cable operators pay a minimum fee of five percent (5%) of the
gross revenue of the cable system paid quarterly;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That subject to review by the Town Council, operators of cable services who
enter into franchise agreements with the Town after the effective date of this resolution shall be
required to pay a minimum franchise fee of five percent (5%) of the gross revenue of the cable
system paid quarterly.
