RESOLUTION NO. 2004-02
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS, DESIGNATING AS OPEN SPACE CERTAIN AREAS OF
LAND RECENTLY ACQUIRED BY THE TOWN THROUGH
CONDEMNATION OF LAND OWNED BY THE LAKES OF TROPHY CLUB
HOMEOWNERS ASSOCIATION FOR THE PURPOSE OF DESIGNATING
THAT AS OPEN SPACE PARK LAND; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Town of Trophy Club, Texas (the "Town") recently acquired certain
parcels of land from the Lakes of Trophy Club Homeowners Association through eminent
domain proceedings; and
WHEREAS, the Town obtained the land through eminent domain in order to develop
and enlarge a park located within its corporate limits; and
WHEREAS, the fee parcels and the access and scenic easements are located on
properties more particularly described on Exhibit "A", a copy of which is attached hereto and
incorporated herein; and
WHEREAS, having acquired the property, the Town declares that Parcels D, E, and F on
the attached Exhibit "A" shall be designated as open space park land and that there will be no
permanent structures built upon such parcels except as specifically authorized or allowed by
Texas Parks and Wildlife or other applicable law, rule, or regulation for park purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. THAT the foregoing recitals stated in the preamble are found to be true and
correct and are deemed incorporated into the body of this Resolution as if copied herein in their
entirety.
Section 2. THAT it is hereby determined that parcels D, E, and F on the attached Exhibit
"A" are designated as open space park land and that there will be no permanent structures built
upon such parcels except as specifically authorized or allowed by Texas Parks and Wildlife or
other applicable law, rule, or regulation for park purposes;
Section 3. THAT this resolution shall take effect from and after its final date of passage
as required by law.
