RESOLUTION NO. 2008-20
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS AMENDING RESOLUTION NO. 2008-01
AUTHORIZING THE CREATION OF A CHARTER REVIEW
COMMISSION; ESTABLISHING OPERATING PROCEDURES OF
THE COMMISSION CONSISTENT WITH THOSE APPLICABLE
TO ALL OTHER BOARDS AND COMMISSIONS WITHIN THE
TOWN AND DEFINING THE SCOPE OF COMMISSION REVIEW;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town is empowered under §51.001 of the Texas Local
Government Code to adopt a resolution that is for the good government of the
Town;
WHEREAS, the Town has a substantial interest in the proper
management and oversight of the Town's Home Rule Charter;
WHEREAS, the Trophy Club Town Council is charged with the
responsibility of making appointments to the Boards and Commissions serving
the Town; and
WHEREAS, on February 4, 2008, the Town Council adopted Resolution
No. 2008-01 establishing the Charter Review Commission and tasked the
Commission with providing recommendations for proposed Charter amendments
for the November 2008 election; and
WHEREAS, the Commission brought forward recommendations for
nineteen (19) different proposed Charter amendments; and
WHEREAS, the Council was in the process of reviewing those proposed
amendments when it was determined that a November, 2008 election would be
impractical; and
WHEREAS, the Council now desires for the Charter Review Commission
to continue its Work on the nineteen (19) Commission proposed amendments
(hereinafter "Proposed Amendments") in anticipation of future meetings with the
Town Council wherein a final determination can be made regarding propositions
that will be placed on a May, 2009 ballot; and
WHEREAS, since circumstances have changed and there is additional
time for Commission review of the Proposed Amendments, the Council has
determined that amending Resolution No. 2008-01, as more specifically set forth
herein, is appropriate for consistency among Town Boards and Commissions
and will facilitate communications between the Council and the Commission as
well as with the residents of the Town;
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF
THE TOWN OF TROPHY CLUB, TEXAS THAT:
Section 1. The foregoing recitals are hereby adopted and are
incorporated herein.
Section 2. As set forth herein, the Town Council of the Town of Trophy
Club, Texas does hereby amend Resolution No. 2008-01 authorizing the creation
of a Charter Review Commission.
Section 3. The Charter Review Commission shall consist of 'five to nine
members to be appointed by the Town Council. Members shall serve at the
. pleasure of the Town Council. .
Section 4. The Charter Review Commission shall serve until the Town
Council takes action to dissolve such Commission or until the date that the Town
Council adopts an ordinance calling the May, 2009 election, whichever occurs
first.
Section 5. Consistent with the practice of all other Boards and
Commissions established by the Town Council, the "Municipality Of Trophy Club
Handbook for Elected and Appointed Officials" and all amendments thereto, shall
apply to the operations of the Charter Review Commission, and the Charter
Review Commission and its members shall be subject to all requirements of the
Texas Open Meetings Act.
Section 6. The Town Manager or his designee shall serve as liaison
between the Town Council and the Charter Review Commission. As liaison, the
Town Manager or his designee shall communicate directives from the Town
Council to the Charter Review Commission and shall at the request of the Town
Council submit reports on the project. The Town Attorney shall provide legal
advice to the Charter Review Commission.
Section 7. The Charter Review Commission shall make
recommendations to the Town Council concerning Proposed Amendments to the
existing Town Charter.
Section 8. At the direction of the Town Council, the Charter Review
Commission shall consist of the following Residents of the Town of Trophy Club.

7. Joel Quile 8. Richard Briggs
9. Richard Hobday
Section 8. This Resolution shall take effect from and after its date of
passage in accordance with law.
PASSED and APPROVED by the Town Council of the Town of Trophy
Club, Texas on this 18th day of August 2008.
