RES 2012-09TOWN OF TROPHY CLUB, TEXAS RESOLUTION NO. 2012-09 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS AUTHORIZING THE CREATION OF A CHARTER REVIEW COMMISSION; PROVIDING THAT THE COMMISSION SHALL CONSIST OF NINE MEMBERS APPOINTED IN ACCORDANCE WITH THE CHARTER; SETTING FORTH THE NAMES OF PERSONS SERVING ON THE CHARTER REVIEW COMMISSION AND DESIGNATING A COUNCIL LIAISON; SETTING FORTH GUIDELINES FOR MEETINGS OF THE COMMISSION; APPOINTING THE TOWN MANAGER OR HIS DESIGNEE TO SERVE AS A STAFF LIAISON TO THE COMMISSION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town is empowered under §51.001 of the Texas Local Government Code to adopt a resolution that is for the good government of the Town; WHEREAS, the Town has a substantial interest in the proper management and oversight of the Town's Home Rule Charter; WHEREAS, the Trophy Club Town Council is charged with the responsibility of making appointments to the Boards and Commissions serving the Town; and WHEREAS, Section 11.15 of the Town's Home Rule Charter provides that the Council shall appoint a Charter Review Commission no later than July 2012, and that the Commission shall consist of nine (9) qualified voters; and WHEREAS, Section 11.15 of the Charter further provides that each Council member shall appoint one (1) member to serve on the Charter review Commission and that the remaining members shall be appointed by vote of the Council; and WHEREAS, Section 11.15 states that the Commission members shall review the Charter and make Charter amendment recommendations; and WHEREAS, the term of office of the Commission shall be six (6) months, and may be longer if extended by Council, and upon the completion of their term, the Commission shall file a report of the proceedings which shall become public record. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. The foregoing recitals are found to be true and correct and are incorporated herein as if written word for word. Section 2. The Town Council of the Town of Trophy Club, Texas does hereby create a Charter Review Commission, which Commission shall consist of nine (9) members who shall be appointed in accordance with Section 11.15 of the Home Rule Charter and whose names are set forth hereinbelow. Section 3. The members of the Commission shall serve at the pleasure of the Town Council, and in accordance with the Town Charter, the term of office of the Charter Review Commission shall be for a period of six (6) months, unless Council takes action to extend the Commission's term of office. Section 4. The Town Manager or his designee shall serve as a liaison between the Town Council and the Charter Review Commission (hereinafter "Staff Liaison"). The Staff Liaison shall be the point of contact for members of the Commission, and it shall be the responsibility of the Staff Liaison to obtain necessary input from Town Staff and from Town Council in order to assist the Commission with the performance of its' duties. It shall also be the obligation of the Staff Liaison to schedule joint workshops for the Commission and the Town Council as needed to facilitate the work of the Commission or as requested by the Commission or Town Council. The Town Attorney shall provide legal advice to the Charter Review Commission. Section 5. The Charter Review Commission shall act in accordance with the scope of duties set forth in Section 11.15 of the Town's Home Rule Charter and shall also undertake a review of specific topics or Charter provisions as requested by a majority vote of the Town Council. The Staff Liaison shall communicate such requests to the Commission. Section 6. The Charter Review Commission shall make recommendations to the Town Council concerning potential amendments to the existing Town Charter to be placed on an election ballot in May, 2013. Section 7. At the direction of the Town Council, the Charter Review Commission shall consist of the following residents of the Town of Trophy Club. 1. Bill Frey 6. Joel Quile 2. J.D. Stotts 7. Lourdes Hassler 3. Larry Mundy 8. Pearl Ford 4. Bert Miller 9. Richard Mayberry 5. Dave Dickson Section 8. Council member Tiffany shall serve as the Council Liaison to the Charter Review Commission, and shall update the Town Council on the work of the Commission. Section 9. All meetings of the Commission, including meetings of any subcommittee of the Commission shall be open to the public and shall be held in accordance with the Texas Open Meetings Act and with the parameters set forth in this RES 2012-09 Page 2 of 3 Resolution. The Charter Review Commission shall meet two (2) times per month, or less frequently if determined appropriate by the Commission. In order to avoid conflict with Council meetings and with other Town and MUD1 meetings, the Commission shall meet on the second and fourth Monday of each month; provided however, that if the date of a scheduled Commission meeting falls on a holiday, if a Council meeting date is changed to accommodate holidays or if a Council meeting date is otherwise moved so as to present a conflict with a scheduled Commission meeting, the Staff Liaison shall work with the Commission to determine an alternative meeting date and time and to secure an appropriate meeting room which will accommodate public access. Section 10. The Staff Liaison shall attend all meetings of the Commission, shall be responsible for preparation and posting of the meeting agendas, and shall ensure that minutes are prepared for Commission review and action. The Staff Liaison shall be responsible for ensuring that all clerical support for the Commission is provided by Town staff. Section 11. Handbook for Elected and Appointed Officials, section Maximum Number of Appointments is waived to allow membership on the Charter Review Commission. Section 12. This Resolution shall take effect from and after its date of passage in accordance with law. PASSED and APPROVED by the Town Council of the Town of Trophy Club, Texas on this 16th day of April, 2012.
