RES 2012-34 Naming the CCPD BoardTOWN OF TROPHY CLUB, TEXAS RESOLUTION NO. 2012-34 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS AUTHORIZING THE CREATION OF A TEMPORARY BOARD OF DIRECTORS FOR A PROPOSED TROPHY CLUB CRIME CONTROL AND PREVENTION DISTRICT WITHIN THE BOUNDARIES OF THE TOWN; SETTING FORTH THE NAMES OF QUALIFIED PERSONS APPOINTED TO THE TEMPORARY BOARD AND DESIGNATING A STAFF LIAISON; SETTING FORTH OBJECTIVES FOR THE TEMPORARY BOARD; SETTING FORTH REQUIREMENTS FOR THE MEETINGS OF THE BOARD; APPOINTING "rHE TOWN MANAGER OR HIS DESIGNEE TO SERVE AS A STAFF LIAISON TO THE BOARD; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town is empowered under §51.001 of the Texas Local Government Code to adopt a resolution that is for the good government of the Town; WHEREAS, pursuant to Section 363.051 of the Texas Local Government Code (LGC), the Town Council took action on November 14, 2012 to propose the creation of a Crime Control and Prevention District with the boundaries of the Town of Trophy Club, Texas (hereinafter "CCPD"), and WHEREAS, the Section 363.052 of the LGC provides that no later than the 60 th day after the date a district is proposed, the Town Council is required to appoint seven (7) persons who reside in the proposed district to serve as a Temporary Board of Directors; and WHEREAS, the Town has solicited applications for persons to serve as a member of the Temporary Board of Directors for the proposed Trophy Club Crime Control and Prevention District and has received qualified applicants for service; and WHEREAS, Chapter 363 of the LGC provides that the Temporary Board shall formulate and approve a two-year crime control plan which must include the amount of money budgeted by the district for each crime control and prevention strategy and the method of annually evaluating the effectiveness and efficiency of individual crime control and prevention strategies; and WHEREAS, Chapter 363 of LGC further provides that the Temporary Board shall formulate and approve a two-year budget plan which must include the amount of money budgeted by the district for each crime control and prevention strategy, the amount of money budgeted and the percentage of the total budget of the district for adrninistration, including individual amounts showing the cost of administration that would be conducted by the district and the cost of administration that would be conducted by private or public entities, the estimated amount of money available to the district from all sources during the ensuing year, the amount of balances expected at the end of the years for which the budget is prepared, and the estimated tax rate that will be required; and WHEREAS, upon approval of a budget plan and a crime control plan as required by Chapter 363 of the LGC, an election for the creation of a district may be ordered and held, and the call of election shall meet the requirements of Chapter 363, including without limitation, specifying the rate for the district sales and use tax; and WHEREAS, the Town Council finds and determines that the formation of a Temporary Board of Directors for the proposed Trophy Club Crime Control and Prevent District serves the public health, safety and welfare, and that such Temporary Board should be formed. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. The foregoing recitals are found to be true and correct and are incorporated herein as if written word for word. Section 2. The Town Council of the Town of Trophy Club, Texas does hereby create a Temporary Board of Directors for the proposed Trophy Club Crime Control and Prevention District who shall serve at the pleasure of the Town Council. Section 3. It shall be the duty of the Temporary Board to develop a two-year crime control plan and a two-year budget plan and to take all other actions necessary under the Chapter 363 of the LGC in order to allow the residents of the Town to vote for or against the formation of a crime control and prevention district within the boundaries of the Town of Trophy Club. Section 4. The Town Council hereby finds that the persons recommended for appointment to the Temporary Board reside within the boundaries of the Town and hereby appoints the follow seven (7) residents of the Town to serve as a Temporary Board of Directors for the proposed Trophy Club Crime Control and Prevention District: Crime Control and Prevention District 1. The Temporary Board is directed to hold its first meeting no later than December 19, 2012 in order to organize and to elect one of its directors as the presiding officer of the Temporary Board. RES 2012-34 Page 2 of 3 Section 6. The Town Manager or his designee shall serve as a liaison between the Town Council and the Temporary Board. (hereinafter "Staff Liaison"). The Staff Liaison shall be the point of contact for members of the Temporary Board, and it shall be the responsibility of the Staff Liaison to obtain necessary input from Town Staff and from Town Council in order to assist the Board with the performance of its' duties. Section 7. All meetings of the Board, including meetings of any subcommittee of the Board shall be open to the public and shall be held in accordance with the Texas Open Meetings Act. Section 8. The Staff Liaison shall attend all meetings of the Board, shall be responsible for preparation and posting of the meeting agendas, and shall ensure that minutes are prepared for Board's review and action. The Staff Liaison shall be responsible for ensuring that all clerical support for the Board is provided by Town staff. Section 9. Handbook for Elected and Appointed Officials, section entitled Maximum Number of Appointments is waived to allow membership on the Temporary Board of Directors. Section 10. This Resolution shall take effect from and after its date of passage in accordance with law.
